Breast Cancer Survivor Awarded $304K for Implant MistakeLos Angeles, CA: A breast cancer survivor has been awarded $304,500 by a jury hearing her medical negligence case against her plastic surgeon. Jodi Breneman, who underwent breast reconstruction surgery in 2007, alleged that during the final stageof the process, which involved the insertion of implants, Dr. Martin O'Toole made an error that caused her to develop symmastia, a condition in which the breast pockets connected and formed a single breast across her chest.Breneman further alleged that as a consequence of this situation, he had to have her breast implants removed and undergo an additional four surgeries.The surgeon argued that symmastia was a known risk of the procedure, and that he didn't act negligently. Following the verdict, Breneman's award was reduced to $254,500 due the California state cap on medical malpractice damages.
