Crash Victim Receives $600K Settlement from Insurer

Los Angeles, CA: A woman injured in a motor vehicle accident in 2008 and who subsequently sued her insurer over her claim, has been awarded a $611,532 settlement.

Lorrice Joyce was rear-ended while traveling on the 110 Freeway in Los Angeles, which, according to her suit, exacerbated her prior neck injuries and caused a new herniated disc at C6-7. She subequently underwent fusion surgery for the new spinal injury nine months later.

Prior to suing her insurer, Arch Insurance, Joyce had received the driver's $100,000 insurance policy limits. She then filed an underinsured motorist claim with Arch. However, Arch argued that the new herniation wasn't caused by the crash, and so refused to pay. Consequently, her suit proceeded to arbitration and she was awarded $711,532, which was reduced by $100,000 to offset the amount she received in her settlement with the driver.
