Medical Malpractice Suit Settled for $1.69 Million

Syracuse, NY: In October 2007, then 31-year old Tina Holstein, a nurse who provides residential care, underwent the delivery of her third child. The delivery was performed at Community General Hospital, in Syracuse. During the delivery's aftermath, Holstein began vomiting, which was dealt with by the dministration of an intramuscular injection. Holstein claimed that the injection caused a permanent injury of her sciatic nerve.

Consequently, Holstein sued the hospital and the nurse who administered the injection, Jacinta Colombo. Holstein alleged that Colombo failed to properly administer the injection, that Colombo's failure constituted malpracticeand that the hospital was vicariously liable for Colombo's actions.The case against the nurse was dropped, but not the hospital.

The jury found that the hospital was liable for Holstein's injury. It determined that Holstein's damages totaled $1.69 million.
