Coca Cola Bottling Company Settles Overtime Class Action

Coca Cola Bottling Company has agreed to settle an overtime class action for $1.1 million. The average net payment to each class member would be about $4,300.

In June 2008 Tom Munoz and Phillip Eichten filed a class action lawsuit against BCI Coca-Cola Bottling Company of Los Angeles (BCI), claiming unpaid overtime wages, missed meal and rest period wages, and other Labor Code violations and unfair business practices. The proposed class action comprised production supervisors and merchandising supervisors in the state of California at any time during the four-year period preceding the filing of the complaint who were allegedly misclassified by BCI as exempt employees.
