Elder Harassment

This is a settlement for the Nursing Homes lawsuit.

Bloomington, IL: (May-20-08) The Illinois Department of Public Health brought charges against Asta Care, a Bloomington nursing home, alleging that the facility failed to protect residents from a sex offender who was a patient at the 1509 N. Calhoun St. facility. The suit accused Asta Care of failing to screen a male resident who made inappropriate sexual advances to staff and two mentally disabled residents.

Court papers stated that the complaints were noted in nursing records dating to October 2006 at the facility. The man, who was termed a sexual offender based upon his behavior at a previous nursing home, was allowed to remain at Asta Care despite the complaints.

As part of a settlement reached in the case, Asta Care was originally fined $22,500, but that sum was reduced to $14,500 for the Type A violation during settlement proceedings earlier in 2007. [RED ORBIT: NURSING HOME PAY FINE OVER SEX OFFENDER]
