Excessive Force

Akron, OH: (May-20-08) Straton B. Kephart, 22, of Cuyahoga Falls, brought a lawsuit against Summa Health System, the City Hospital; an emergency room doctor, Michael Beeson; a nurse, Tim Knapp; and Summa Emergency Associates, alleging that he was restrained on a gurney and forced to give blood and urine samples after he was involved in a car crash in 2006. The suit also named Tallmadge Police Department and an officer.

Court papers showed that Kephart and a female passenger were taken to the emergency room after a one-car crash in Tallmadge in October 2006. Kephart alleged that he was blocked from leaving the emergency room by a hospital guard and pushed onto the gurney, with his limbs 'restrained.

In a recent development in the case, sources stated that all claims have been dismissed in the civil multimillion-dollar civil lawsuit. An out-of-court settlement was reached with the Tallmadge Police Department and an officer, but the amount of the settlement was not available. [AKRON BEACON-JOURNAL: HOSPITAL DROPPED FROM SUIT]
