Gender Identity

New York, NY: (May-13-08) The Transgender Legal Defense and Education Fund, on behalf of Khadijah Farmer, a lesbian woman, brought a lawsuit against the Caliente Cab Company, a popular Greenwich Village restaurant, alleging that a bouncer chased her out of the women's bathroom and forced her to leave, stating that she looked masculine. Farmer said that the incident took place June 24, 2007, during the New York City's annual Gay Pride march. Sources stated that the two sides had reached a settlement, in which, the Caliente Cab Company agreed to pay Farmer $35,000 to resolve allegations.

The company said that the settlement was reached with the admission of no wrongdoing, and that it denied the allegations, disputing the portrayal of the events as reported by Farmer. Company spokespersons said that under the settlement agreement, Caliente also will add gender identity to its non-discrimination policy; amend its employee handbook with a section on customer restroom use; adopt a gender-neutral employee dress code; and train workers on the new policies.
