Foster Parent Neglect

Morris County, NJ: (Jan-10-08) A lawsuit was brought against Debi Canella of Hanover, a former foster parent, accusing her of neglecting her 10-month-old foster daughter who was injured when she was left unattended in a car seat for about 30 minutes in 2003. The suit claimed that Canella left the sleeping child in her car seat in her automobile, which was parked in the heated garage of her home. Though Canella claimed she checked on the child repeatedly as she completed household tasks, at some point the baby's car seat buckle came undone and the girl was choked by the strap that held the car seat in place.

Aviana Loper, who now is 4 and was under the foster care of Canella on Dec. 15, 2003, was initially diagnosed as having suffered traumatic asphyxia at being choked by the car seat strap. As part of the settlement reached, Canella agreed to pay $70,000 to end the lawsuit. Canella's insurance carrier agreed to cover the $70,000 payment, which will be placed in trust until Aviana turns 18. [DAILY RECORD: FOSTER PARENT NEGLECT]
