Car Dealer Discrimination
This is a settlement for the Discrimination lawsuit.
Wilmington, DE: (Dec-27-07) The US Equal Employment Opportunity Commission (EEOC) brought charges against Burton of Seaford LLC, a subsidiary of Burton & Co. Inc., alleging that the Delaware car dealership unlawfully fired three people based on age. The agency stated that age discrimination violates the Age Discrimination in Employment Act (ADEA), which protects workers older than 40 from employment discrimination based upon their age. The EEOC filed suit after first attempting to reach a voluntary settlement. According to the commissions report, Burton terminated Blair McMasters and others from the jobs as runners at the company's Seaford location on the basis of their age. The commission stated that the job duties of McMasters and other runners included driving dealership vehicles and delivering them to designated areas and picking up cars from customers for service or repairs. Officially, Burton maintained a policy of discharging runners right before they reached the age of 75.
As part of a settlement reached, the Delaware car dealership agreed to a $70,000 payout to resolve allegations. Besides the monetary award, the consent decree settling the suit also provides for training of supervisors and managers regarding employee rights and employer obligations under the ADEA, and the posting of a notice regarding the ADEA and the resolution of the lawsuit.
