Illegal Tree Cutting

Newton, NC: (Nov-15-07) James Powell, a property owner, brought charges against the city of Newton, alleging that the city was responsible for the illegal cutting of trees on his property. City officials claimed that when the city began developing property on NC 10 as a park, a survey was done and the city contracted a company to clear the land. The company contracted by the city subcontracted the work to a logging company, leaving the city blameless. While a trial was underway, documents reveal that the two parties came to a settlement, which sources for both sides say was mutually satisfying.

Newton City officials said that Powell will receive a total of $40,000, but the city's portion of that amount was set at $20,000. Insurance and other parties involved in the suit will pay the balance. Further, although a monetary agreement was reached, neither side accepts any liability or wrongdoing, but stated that the deal was signed so as to avoid the costs and risks of litigation.
