Michael Tomko Jr. and Magnesium Elecktron Inc.

Mercer County, NJ: (Jul-17-07) George Kidd brought a lawsuit against Michael Tomko Jr., and his employer Magnesium Elecktron Inc., accusing them of negligence, claiming that Tomko failed to exercise due care in the operation of the tanker truck that he was driving on February 2, 2004. As a direct result of the negligence, Tomko collided with Kidd, who was standing on a sidewalk with his bicycle when he was hit by the truck. The accident resulted in Kidd being hospitalized for months for treatment of broken legs and other related injuries. In a settlement reached, Kidd received $2 million as compensation and $574,000 for future medical care. Officials state that the amount Kidd will receive was capped at $1.1 million, after deductions.
