Pierce County, WI: (Jul-05-07) Andrew Junior Diesing was born eight months after the death of his father, Andrew P. Elsen, 21, of Ellsworth. Elsen died in an accident that was caused by the negligence of Kyle A. Jensen, who was subsequently found guilty of homicide by intoxicated use of a vehicle and second degree recklessly endangering safety. Since Jensen was insured by State Auto Insurance Company, Columbus, Ohio, a lawsuit was filed against the insurer which resulted in the settlement of the wrongful death lawsuit. The company agreed to settle the wrongful death claim made on behalf of the child by paying the policy limit of $250,000. Of that amount, $150,000 will be held in trust and paid out upon further order of the court. The other $100,000 will be used to buy an annuity contract that will pay $300 a month to Andrew Junior until he turns 18; $20,000 a year beginning in 2024 for five years; a lump sum of $35,000 at age 25; and $75,300 at age 30.
