Ciminelli Services Corp. and RBS Excavating

Kevin Campbell Auchter was a culinary student who worked as a demolition laborer for Ciminelli. On February 24, 2000 at the age of 22, Kevin was killed during the demolition of two silos at the Monterey Coal Co. in Albers. He was preparing a silo for implosion when a huge chunk of concrete jarred loose from within the silo and hit him. Kevin's father, Thorne Auchter, who happened to serve as the head of Occupational Safety and Health Administration from 1981 until 1984 filed a wrongful death lawsuit against the two companies. The lawsuit alleged negligence as no demolition engineering survey was prepared prior to the concrete's removal. Ciminelli paid $2 million of the settlement, while RBS Excavating contributed $300,000. (Apr-19-06) [BELLEVILLE NEWS DEMOCRAT]
