United Parcel Service, Inc.



A class action lawsuit has been filed against the United Parcel Service, Inc. on behalf of employees of the company between March 2000 and the present. The suit alleges systematic violations of the Americans with Disabilities Act. The suit is seeking a permanent injunction to enjoin UPS from engaging in discriminatory employment practices in violation of the ADA, as well as the implementation of policies that provide equal employment opportunities for persons with present, past or perceived disabilities.

My reasonable accomodation request for my medically documented ADHD, that was diagnosed over 15 years ago, for training and test in a quiet setting was denied. The reasonable accomodation request for my asthma is still under investigation. I signed a UPS medical information authorization release for UPS that had an expiration date. I discovered that UPS contact my doctor directly for additional information on my asthma after the expiration date, and without contacting me for another signed medical information authorization release. On 6/18/07 I received a certified letter from UPS "reminding" me that I needed to get the "additional" asthma information to them by 6/19/07 or they would consider my request withdrawn. UPS never asked, or mailed me, a second medical information authorization release to signed. UPS's letter stated that they have not received any communication from my doctor; that is incorrect. Amber, the doctors records clerk, contacted me by phone a week after she received the new request from UPS. She informed me that UPS had sent the doctor a request without a signed medical information authorization release. A week later UPS actually call the doctors office and spoke to Amber asking where the information was. She informed UPS that they had not sent her a signed authorization and that she could not release the information. That is when UPS sent me the "reminder" letter. I have ALL documentation, including the certified letters and postmarked envelopes. UPS can not produce a certified mail number or return receipt signature. UPS is "busted", and I have a neutral third party witness that was start enough to do her job correctly.
