Class Action Lawsuit Filed Against National Union Fire Insurance

Los Angeles, CA: An insurance class action lawsuit has been filed in the United States District Court for the Central District of California on behalf of designated beneficiaries of occupational accident insurance underwritten by National Union Fire Insurance Co. of Pittsburgh PA ("NUFI") purchased from NUFI's authorized agent, Associated Underwriters, Inc. ("AUI"), or AUI's related entity, United Truckers Association, (together, the "brokers") before April 1, 2008 (the "Class Period").

The lawsuit alleges that NUFI, through the brokers, sold occupational accident insurance to truckers that failed to specify the terms of the insurance policies. Truckers filled out one page application forms for insurance that asked questions regarding the insured and listed only a total amount of coverage sought by the insured. The brokers then sent the insured a one page certificate of insurance that did not clearly indicate the terms of coverage, including purported sub-limits on the policies. Truckers then paid premiums for the insurance policies, believing they were insured to the full amount shown on the application.

The lawsuit further alleges that if a beneficiary sought to collect on the policy, NUFI claimed that various sub-limits -- which had not been previously disclosed in a clear manner to the insured -- applied, and limited its payment accordingly. At least one court has already ruled "certificates of membership insurance" identical to the ones at issue in this case are unclear regarding the terms of coverage NUFI claims apply. The complaint has been filed as a class action and can be obtained from the Court.

My mother purchased this same policy in 2004, through NUFI/AIG of Pittsburgh and I have been trying for months to get them to email me a copy of the contract or at least the policy information that was offered in 2004. My mother received a monthly payment and received SSI at the same time. When I filed her SSI disability claim I informed them about her permanent disability check from NUFI/AIG Insurance Policy. She was a owner/operator and was leased into a trucking company in Waco, Texas. Now SSI sent her a letter stating she now owes SSI $57,000.00, for overpayment even though the local SS office employee in Waco,Texas can clearly see I told them about the insurance policy when I helped my mother file for SSI-Disability in 2006 and they said they would adjust her monthly payment from SSI. The reason is because they think it was Workmen’s Compensation and not a Occupational Accident Insurance Policy for people who are self-employed/contractors.There is no way a person could receive workmen’s Compensation for over 17 years especially in Texas or any other state because I think back then a employee could sue the company they worked for, but contractors had to sign a form that said they released the company they were leased into and are liable for any accident they might suffer. She is 71 years old now and has LBD Dementia with psychiatric problems due to the type of dementia. Please I beg of you, if anyone has any advice about how to get a copy of the policy from 2004 even just a picture would work or other advice we would tremendously grateful. They are supposed to stop her retirement benefits in November 2022 and currently she receives a $600.00, a month check minus $140+ for Medicare and $21, a month for her and my father. He is disabled because he suffered a cerebral aneurysm in 1988 and can’t read, write, spell and doesn’t have cognitive functions. Plus to put the cherry on top my baby sister scared them with the SSI letter and manipulated them into signing over their five acres that they have worked for, for over 30 years by telling them that the government was going to take it, if they didn’t put it in her name. The devastating thing is that it had been homesteaded since the beginning and my sister’s fellow employee/friend had her friend that drew up the legal documents is the attorney that even knew it was homesteaded for over thirty years and immediately homesteaded it and went and purchased a $175,000.00 custom Doublewide mobile home and new everything for it by securing it with my parents five acres that she took. I recently found out about all of this by accident because she had sent my mother threatening text that she would file eviction charges, if they allowed my sisters and I to come back on the property. The irony is my parents adopted her when she was two weeks old and that was almost forty years ago. Of course, Adult Protective Services of Texas won’t help and two separate cases have been filed and the only thing they do is ask my mother if she has any food and she tells them yes because her generation doesn’t want to impose, plus she forgets that the rats and roaches have eaten most of it. My husband and I have been doing all that we can to help out with the problems, but even the property case has been so overwhelming because for months I have tried and tried to find a attorney to help and have reached out to all the legal aid type and state discounted attorneys however I don’t even want to answer the phone because over and over I’m being told either it will cost more than the property is worth or they don’t have that type of attorney available, but I won’t give up and I would ask that anyone that can help please pray for us because I believe in miracles and eventually it will find us. Hi, I have this insurance for more than 4 years, first of all have no idea how I got it but I noticed some money was withdraw every month, basically called them and they explained to me what was it, anyway I had it and then my wife had a health issue, so I called them and they never sent any paperwork to file, they kept saying that they are going to send and they never did, so this situation was in the 2nd year, so I have another problem ( this one was in the 4th year) so I called them again and tried to open a claim and they said the same thing " they will send a paperwork to my home address" and they never did , so this time I told them until I have not receive the paperwork do not take my money, until now there is no paperwork and I've being calling and always they said We will send it again, I don't believe them anymore

I think this company is horrible and they need to respond for what they are, if you can help me would really appreciate it, i would like to

I had an account with nuf insurance. when I needed assistance with a back surgery they denied assistance so, I cancelled my account with NUF. found out later on that they still was taking money out of my account when my account was supposed to have been cancelled four years ago. I am looking for an attorney to help me get my money back that nuf Insurance really "literally" stole out of my Wells Fargo bank account.

I had a claim back in 2012 and they wouldn't payout stating it wasn't accidentally but it was. Was hit in abdomen and a hernia was busted by accident in my stomach so i had to have emergency surgery. I have wrote letters, medical records still denied my claim.
