MetroPCS Faces Potential Class Action over International Calling Plan

New York, NY: A class action suit has been filed on behalf of those who purchased or otherwise acquired products and/or services in reliance of MetroPCS Communications, Inc.'s ("MetroPCS" or the "Company") false advertising, not knowing that there were major restrictions to the unlimited international calling plan during the period between June 1, 2009 through and including December 9, 2009 (the "Class Period"). No Class has yet been certified in the above action.

The complaint says that MetroPCS offered unlimited international calls for a mere $5 a month, on top of the $45 flat fee attached to the company's "Ultimate Unlimited" plan, but never mentioned to consumers that the plan excludes calls to many foreign destinations. According to the complaint, class members bought the service "in reliance of such advertisements." The complaint accuses MetroPCS of using "bait and switch/deceptive trade practices," including misleading advertising, to lure customers into signing up for the plan. The complaint alleges that MetroPCS is in violation of New York General Business Law 349 and 350 and substantially similar statutes of different states.
