Class action status is being sought in a lawsuit filed against Kenton County, Kentucky on behalf of all taxpayers and businesses in the county. The suit challenges the legality of a payroll tax adjustment made by the county in 1995 when the Fiscal Court increased the transportation portion of its payroll tax to 0.6 percent from 0.4 percent to pay for a new parking garage. The plaintiffs claim that the increase to the transportation levy is subject to offsetting credits for workers who also have to pay city payroll tax. (Feb-03-05)
