Harvoni

harvonihepcHarvoni, sold by Gilead Sciences, is a hepatitis C treatment. Hepatitis C is a contagious, potentially fatal, liver disease that is contracted through exposure to the blood of a person infected with it. Complications linked to hepatitis C include severe liver damage, infections, and liver cancer. Patients with hepatitis C can also experience other adverse health effects, including fatigue, pain, fever and arthritis.

According to court documents, more than three million people in the US have chronic hepatitis C, with 15,000 people dying annually of liver disease linked to hepatitis C.

In October 2014, the FDA approved Harvoni to treat hepatitis C. According to reports, Harvoni cures more than 90 percent of patients infected with hepatitis C in as little as eight weeks and with few side effects. Of concern is the cost—Harvoni costs around $99,000 for a 12-week program, according to documents filed in a lawsuit.

Harvoni Denials

unumdeniedstampInsurance companies are accused of setting restrictions on the hepatitis C patients who are approved for Harvoni treatment. Plaintiffs allege they have had their Harvoni claims denied on the grounds that it is not "medically necessary."

According to documents filed in one lawsuit against Anthem Blue Cross, the plaintiff was denied Harvoni treatment on the grounds that her liver was not damaged enough to warrant treatment. In other words, the plaintiff' liver had to have significant enough damage to warrant treatment, even though the treatment is designed to prevent liver damage and despite the plaintiff's doctor writing repeated letters on her behalf.

Harvoni Insurance Lawsuits

Lawsuits filed against insurers like Anthem Blue Cross and Blue Cross and Blue Shield of Florida allege the insurers breached their contractual duty to provide coverage for medically necessary treatment. They further allege breach of good faith and negligent infliction of emotional distress. Lawsuits filed in California also allege insurers deny treatment to increase profits, a violation of California law.

Insurers have defended their decisions, saying Harvoni was approved through a process that meant it was tested in fewer people, raising concerns about the benefits and side effects associated with the drugs.

Harvoni Insurance Claim

Some policyholders may have their claim preempted by ERISA (Employee Retirement Income Security Act). Policyholders who aren't likely to have a preempted claim are those who have insurance through an employer who is the government, a church or other religious entity, or who have their own self-insured policy—that is not through an employer, Medicare, Medicaid or the VA.

My 52 Year old brother took Harvoni to cure his hep. C It cured him.
He wasn't informed that there had been cases of people developing liver Cancer after receiving treatment. I think people deserve the right to know if there's any controversy about possible side effects.
He died of Liver Cancer August 20th 2018. 13 days after the doctor told my brother he had up to 6 months to live. He went very fast and didn't have a chance at beating the cancer. I also think the doctors lied to him and didn't tell him he had cancer earlier until it was to late. Be careful when it comes to doctors cause medical error is one of the leading causes of human death.

So Sad that insurance companies that no nothing about disease and only look at the bottom line $$$ are the ones allowed to make medical decisions for us. People need to write to their states representatives and start changing this. On the other hand the reason for denial is $$$ the pharmaceutical company for Harvoni is charging $1200.00 per pill, which is an outrage, a 3week course of this med is $94,000.00 which is why they won't cover it. However, not covering this product will cost them more in the long room, because now they will have to pay for the treatment of liver damage. On top of that, those that do not have liver damage and not covered, will continue to spread it. How dumb these insurance company and pharmaceutical companies are..however we the ppl are allowing them to do this!

I am positive , but not my other two children. Doctor thinks I gave it to him at birth...I have twins , and other twin doesnt have so i really dont know how we got it . His levels are worse than mine but not bad at all , no liver damage , I was approved by optom rx but he has differant insurace and was denied because he isnt sick , this is more than an outrage,i WONT TAKE MINE UNTIL HE IS APPROVED. I just dont get it, he and anyone who has this could spread it , we dont know how we got it so..who knows..I found a lawyer and think a lawsuit should be filed , and supreme court should get involved , the media , any help would be appreciated...I say we fight!!!!!!

I am also being denied (3 or 4 times already) . wanted to mention what I heard.
That as of Jan 2016 some Anthem and United Health Care
states are not denying due to the not sick enough thing anymore. Can't find this published, but a Gilead Rep told me that.
FloridaBlue is one of the hold outs that won't change their definition of "medical necessity" concerning patients.
I have requested the criteria they used to deny my claim.
(they use comparative research from who knows where and who knows what)
also getting tested for EHMs I am feeling tired and sick last two years, did not realize HEP C can cause many other health issues, speaking to lawyers too.
won't say much about that, just wanted to make some aware that things are changing , probably by 2017 all will be covered for Harvoni. Lets hope.

I have been denied 3 times by Florida Blue, I just got my 3rd denial letter today, my doctor says I meet all the criteria and I will be approved eventually ! Should I be searching for a lawyer now or just keep waiting. I have private self pay Florida blue at $802 a month with no subsidies. my income is boarder line for subsidies. just over the limit, but after rent, car payment and other bills it is tough to pay every month, I feel they are putting this off till Dec. 31st when my policy expirers , then the will raise the price of premium !

I was first denied Hep c treatment in 2003/I was diagnosed in 1998. I had been sober over five years. I was denied because of my bipolar disorder as time passed I went to work and got bipolar treatment but the drug I took cause liver damage ( lamictal I took the dr g 13+ years. I now can't get treatment because of the preautherazation process in Ohio medicade rules I'm now in final stages of li er disease. The dr. I've seen would not prescribe medication because I was not a good candidate for treatment be cause I anmited to using recreational drugs and to having occasionally a beer. I had been in substance abuse treatment since 19yrs old.
In the process of waiting for treatment even though the dr knerlw I had verisies sto.ACH ulsers herniea history of mostly alcohol abuse and mental illness I was not educated about my disease I ended I end up with five blood transfusions in five months the hospital called my family in. I was dieing didn't know it. Today my specialist won't prescribe preventive medicine because my M.D. did id y specialists would have educatede and kept a closer eye on me I wouldn't be dieing at this time I don't drink alcohol but after three clean urine test he didn't prescribe Hep med cause I got one dirty am I not worthy of medication because of something I've been dealing with since I was a baby I was expected to Die at 3yrs with phenomena in 1963. My mental health issues Ive been dealing with all my life there is now the the chance of dieing of hep c. I pray God isn't done with me yet.

For all those with liver issues, get yourself on a good quality Milk Thistle immediately. Be pro active when it comes to your health & don't just sit & wait! Eat ONLY organic, grow it, juice it, research what your liver needs & be accountable for your health! My fiancee just finished the Harvoni program & so far so good. But he is at stage 3. He has been on Milk Thistle for over 10 years & eats a clean healthy organic diet, no red meat. If it weren't for those precautions he would be in much worse shape. The liver can rejuvenate & hopefully with the continued organic eating & juicing, the virus being undetected we are optimistic. Good Luck to you all & please be proactive now!!

My husband was infected with Hep C back in the 70's when he was a baby through a blood transfusion. He has Medicaid and was approved in 2014 for Harvoni after getting denied 3 times. The 3 month treatment went well, no bad side effects. You could tell he was getting better and feeling better. But the treatment failed to cure him. About 5 months after the Harvoni treatment he got a call from the doctor that the virus was back and ever since then our appeals have been denied over and over again for any other treatment or medication. He has Hep C genotype 1a with Stage 4 Liver Cirrhosis. His side effects are getting worst by the week. He has extreme itching all over his body, chills even in 100 degree weather (we live in Florida) he wears sweaters and jackets 24/7. Nausea, diarrheas, low appetite, his eye and skin have gotten yellowish, etc... I don't understand why it's allowed for any insurance to deny a patient of life saving medication at all! It should be illegal! They play with peoples lives, deciding who gets to live or not! To me what they do should be considered murder! I have wrote letters and made calls to so many people and organizations trying to get him help, it's heartbreaking for me and our children to have to watch his health deteriorate and feeling like we can't do anything about it. He was even referred to a Research Clinic to try and qualify for a free study treatment but he didn't qualify for any of the programs either. We're thinking maybe if we get a lawyer involved maybe we can get him help before it's too late.

Please sue and sue some more to make sure every patient has the right to those outrageously price drugs Sovalid and Harvoni. In addition, all patients that are denied go to India to buy your medicine for $1500. Its worth it. India provides about 60% of all American generics and China provides about 30% of injectables. Its okay if you think these countries are poor and backwards, just take and advantage of their low cost medicine. Also, you can google things like "harvoni price in india" or "sovaldi price in india". Sometimes if you put a .com on these website you may find some answers. Wish you folks all the best, but don't let these primitive people tell you if you can live or not live. You can get these medicines from India for the fraction of the price. Don't pity yourself and get angry at the worthless US healthcare system. Do something about it, so many other people have.

After going through interferon/riboviron treatment for the full and excruciating course in 1998, only to result in failure of eradicating the Hep C virus, I waited for years for a drug like Harvoni to come to market. I was approved in November 2015 to begin treatment which would consist of the 6 month regiment due to my being "treatment experienced" and having chirrosis (stage 4). Getting my monthly refills went without issue until 5 days ago... Every month, 5 days before I'm actually due for my refill, I call my local pharmacy to remind them that the date for refill is pending to ensure that they have it available and avoid any interruptions in my treatment; however, when I went in 5 days ago, I was told that Optumrx (my drug coverage company) required another preauthorization from my care provider. I immediately got on the phone to contact her, even calling the local emergency room to see if a doctor there could contact her on my behalf and have her call me. The pharmacy also tried to reach her, as did Optumrx. Finally, she called me at 5:10pm last night - no apology, nothing; matter of fact when I told her that I had now been without my medication (Harvoni) for 4 days, she told me that even if I'd gotten hold of her she couldn't have done anything to assist me as she doesn't work on the weekends and only 8 am to 5 pm. Wow! She finally submitted the PA paperwork to Optumrx last night but now Optumrx is telling me that their pharmacist has to review it before [continued] approval. I have spoken with the Harvoni hotline nurse twice and this interruption in my treatment now reduces my chances of success (being cured). Even after explaining that to my doctor and to Optumrx, there was absolutely no concern or sense of urgency on their part. I am devastated by this, as is my family and now, going on day 5, I am still without my Harvoni medication. This should never have happened and, rather than being full of joy that, fianlly, I will be cured, if and when I get back on my Harvoni treatment, it will now be a constant source of stress for me knowing that I very well may not be cured because of this interruption in my treatment. I don't want this to happen to anyone else. Please - before this happens to you - talk to your care provider about the issue of prior authorizations arising mid-treatment and have a plan in place so that this doesn't happen to you!

I just wanted to give alittle hope to those getting the denials. I too have Hep C, genotype 3. I rec'd my first two "not medically necessary letter back, but my doctor kept appealing. I was told I needed to use interferon first...all the same stuff. But I just tried not to get upset, watched the internet and lawsuits. And my doctor kept the appeals going. I got a Liver Biopsy, not real long term damage(necrosis) but my enzymes were very high and I had the increased hepatic steatosis "fatty build up. " I was at the point the I was looking for another insurance co, when MY APPROVAL CAME THROUGH!! I was told by an insurance lady that If You Keep appealing, you will be approved on the 3 or 4 appeal.(Mine took 5 appeals!! Oh, I also wrote a letter (online) to the Insurance Board, And sent in a request for my records..(like I was preparing to sue). You just have to stay at it..I think. Good luck to all. I have been on Savaldi and Daklinza for 4 weeks. With NO side effects! I take it an hour before bed, no problems sleeping. I wish ya'll all the luck!! Jan

I was told in 2000 I had Hep C at a blood bank. Just recently I had test through my primary doctor. I do have Hep C. I have Ga. Medicaid. I was run through test over a period of almost a year. Between doctor visits and testing. Well I was sent a letter from Medicaid. And the doctor treating me. That I was denied, because, I wasn't sick enough. I had no liver damage. In other words they know I have it but won't give me the meds to get rid of Hep C. They wait until you contract a life threatening illness. So, they can continue to make money from illness. That the Harvoni would have stopped me from getting the illness. It's all about money. From the docs treating you. Imagine if they gave everyone the cure pill. Then they would miss out on billions of $ for treating you for the illness you would have never gotten. If you had the Harvoni. I can not believe how they get away with what is obvious. Favoring making money, and curing people. Don't be fooled. Doctors don't want a cure for anything. How would they make money. If you doctors are really in it to help people. Then stop your selfish motives. Money! Period! Is their driving force. They don't want a cure for anything. Only treat it. Keep you alive as long as they can by giving all these meds that do nothing but ease the suffering till you die. By that time. Do you realize how much money has been made from treating, an illness like Diabetics! Do you really think, if they found an absolute cure for Diabetes. They would announce it. It would be like shooting yourself in the head. to be blunt. I'm so sick of these kinds of people. Something has to be done. And no politician will help. Who do you think gives them millions of dollars. The pill mills! That's what I call them. They are some of the most unethical people you will find. Among others. So, what can be done.

I have hep C stage 3, genotypes 1 and 2. I have Medicaid (Care Oregon/Oregon Health Plan). My hepatologist was denied 3 times, trying to get the Harvoni for me. My appeal was denied. I am now going to go for an Administrative Hearing, through the State, not the insurance company. I have Severe Fatigue, among other things. I think that the laws are being broken regarding access to this medicine. Any other folks from Oregon in a similar boat?

Now that our doctors put us through all the test and expectations for the health insurance companies and making money (our doctors). Well the doctors made out he/she should have known we were getting denied if or livers were not in a death stage. I'd say sue the doctors as well.

We need to unite and have a million "man" march in Washington. So many people are not even aware that this is happening, and I agree, it equates to murder!!

playing GOD by the insurance companies (who gets treatment and who does not) for the sake of their bottom line is actually understandable because it will bankrupt them to treat everyone right off the bat. But the pharmaceutical companies are disgusting for charging $1000.00 per pill !
How can anyone deny life for profit?

New twist to Optimun RX / United healthcare. They need me to prove I can not take interferon alpha; which has a low cure rate and has so many side effects it would use up this whole blog.
I have Geno 3;F4 ; but they want me to take a drug that will damage my liver even more and probably keep my from holding a job that pays for my insurance. And the when your not naive and have failed your first treatment its even harder to get treated again. Do you know that Pharassist that developed this drug was supported through federal grants and the head at the time was a VA doctor on the government payroll; then Gillead bought them out ; never had any R&D money in it and just overcharged as much as they could; In India you can treated for under $2000.00 total; its not that hard; look up Greg Jefferys.

Something has got to be done. We need to be heard! Maybe we should write to our Congressman? Obama? (what a joke) I called support path through Gilead pharmaceuticals whom make Harvoni and Sovaldi. Get this, I do not qualify for patient assistance because I have insurance!! Its a damn catch 22. Damned if you have insurance. ( because Im not underinsured) cant qualify but damned if you dont have ins because the IRS will tax you. Wtf. Im furious about this ordeal! I have no clue how I even contracted this damn virus.

Hi All,
I work in a healthcare setting where we primarily treat HCV patients. Here is what you need to be approved for Harvoni through BC:

You must include the following labs and they must have been completed in the last 6 weeks prior to sending:
CBC w/ platelets
AST/ALT
Total bilirubin
Serum albumin
PT/INR
Serum creatinine
GFR
Your baseline HCV RNA must have been done in the last 6 months.
Your physician must include a statement that you either 1) have been screened & tested for alcohol and illicit drug use OR 2) state that you are currently in treatment.
as well as a statement that you do not/ will not take St. John's Wort.
A fibroscan or biopsy staging score of F3 or F4 UNLESS you are coinfected with HIV and then you may be approved at lower scoring (7.0 on a fibroscan).
If possible, a Child Pugh score is helpful.

You do not have to be Genotype 1 but there are different criteria for other genotypes that I can send to you if you like. The criteria for any Anthem Blue Cross medication can be found here: https://www.anthem.com/pharmacyinformation/priorauth.html

Best of luck!

I was just called by my doctor today, he said they have tried everything i have been denied for the 4th time, reason being i am just not sick enough. I am feeling a bit down at the moment, this is very frustrating knowing that the cure is out there but i can not have it. Im upset with the drug companies, and my insurance company. I want to live without the worry of possibly passing this to my children or my husband. This needs to be fix, none of us should have to wait till we are sick! It is wrong to place profits before morality.

I am a 24 year old female with 6 years clean time. I was told that my liver has not been affected by the hepatitis C so therefore my insurance would not cover the costs of treatment. I was also told that it costs just $4 to make one pill then it gets sold for $11. So am I supposed to wait until I am bedridden along with all of these other people? It's ridiculous. It's like the insurance is only willing to pay for the medicine when it's not going to do anything, so all that money will be wasted. When your liver gets to a certain point, there is no return. WHY WAIT? I am trying to get treatment before my son has a sick mom who can't do anything with him. I simply don't understand. I know that it's all about the money for most doctors, but my doctor is so frustrated that he can't do his job....his job is to heal people and make them healthy. He cant' do that when the insurance companies are tying their hands, claiming they can only give the medicine to the people who won't benefit from them. It's like closing the barn door after all the animals have ran out. It's just so frustrating.

I received the exact same, word for word denial letter within two days from Anthem. Appears to me that's it's a template used to deny everyone that needs Harvoni. Still appealing and don't really see a solution. The insurance company went as far as to tell me I should try assistance from the drug company and some other lame, bargaining excuse so they don't have to pay as my options. They sure don't mind taking my premium every month. I guess I didn't realize that my premium only covers specifics. Something needs to be done!

I received my denial letter from United Health Optum RX after waiting a few years for this medication to come out to find out insurance will not cover it because I am NO)T sick enough, so I have to wait until I am sick, can't work and have no insurance to fight a bigger flight, insurance makes no sense, United health has criteria on one website I found that contradicts the letter I received, I didn't do prior medications because my doctor knew Harvoni was coming out and he said I would be a GREAT candidate for it and have a great chance of being cured of the disease only for my insurance company to tell me I'm not sick enough, are you kidding me, I do not do drugs and can prove that and I never had any other treatment which states in writing from a past united health post that i would be covered for 12 weeks, now they are denying PA and telling me I am not sick enough, if i can sue them and I will, this is just wrong to make people wait until they are sicker to get help!!! why the hell do I pay insurance, it preventative but insurance won't cover it because cost is to high, like we don't pay enough for insurance!! I have paid insurance and paid for this medication 10 fold over the years of not using my insurance,. where is all that money??? If you can help me please do!!! This shit needs to stop! I have had hep C for years and waited for a cure, not there is one and I can't get it because of health insurance says so!!! Why go to the doctor lets ask insurance company what is good for my health!

My husband was diagnosed with hepatitis C. I have been fighting with the ins co BCBS since June 1st. We r at our wits end. He has a head to toe rash very itchy 24/7, fever on and off, very fatigued, pain, swelling. The tests show he has genotype 1, fatty liver and almost in cirrhosis stage. He's getting worse as the months go by. Why show the commercial or why does my insurance say it covers it and we can't get it. I wrote a long letter to them that his levels have been off since July 2013 but no one came up with the diagnosis until march 2015 and couldn't get in with a specialist until June 2015. This is horrible! Do u have to be on your death bed before someone does something? Almost 3 months of fighting and we r in appeal again!! Ugh!! I'm not going to stop fighting for my husband! I will obtain a lawyer if this last appeal gets denied! Very frustrating!
