FedEx Drivers File Unpaid Overtime and Wage & Hour Class Action Lawsuit

Pittsburgh, PA: FedEx is facing an employment class action lawsuit alleging violations of the Fair Labor Standards Act (FLSA). The complaint was filed by Sanel Hodzic of Pittsburgh, on behalf of himself and similarly situated individuals, and is claiming wage and hour violations going back to 2012. The lawsuit defines the putative class members as any employees who worked for FedEx within the past three years.

According to the complaint, FedEx intentionally misclassified its drivers as independent contractors for the purpose of avoiding paying them fair compensation. The lawsuit cites previous cases supporting the claim that drivers are employees and subject to FLSA regulations and protections.

Further, the complaint contends that FedEx drivers regularly work in excess of 40 hours per week but fails to compensate the employees by paying an overtime rate, a violation of the FLSA.

Hodzic seeks monetary damages of unpaid overtime wages, liquidated damages, interest, attorneys' fees, and court costs. He is represented by Peter Winebrake, R.
