Farmers Faces Bad Faith Insurance Class Action Lawsuit

- by

New York, NY: A bad faith insurance class action lawsuit has been filed against Farmers Insurance Group Inc, alleging the company fails to fully reimburse policyholders for medical expenses.

The lawsuit, Morawski et al. v. Farmers Texas County Mutual Insurance Co. et al., Case No. 13-cv-00102, U.S. District Court for the Eastern District of Texas, filed by plaintiff Theodore Morawski, alleges Farmers Insurance intentionally shortchanges policyholders who have private health insurance by only paying for medical claims their private insurers won't cover instead of reimbursing policyholders for all incurred medical costs.

"The Farmers Insurance Group pays only the lesser of the 'paid' medical bill, in direct violation of the insurance contract, and is thereby trying to benefit from a prudent insured who has private health coverage,"the lawsuit states.

The Farmers class action lawsuit is brought on behalf of all Farmers Insurance automobile policyholders in Texas who carried personal injury protection (PIP) benefits and or medical payment (Med-Pay) benefits and who were underpaid for medical expenses.

I was injured by another motorist and Farmers faught tooth and nail to not reimburse me on over $110,000 in legitimate medical bills. I had a $1 million umbrella that Farmers refused to honor. They claim that I never notified them of the umbrella that I purchased from them. I'm still paying off these medical bills and will never consider Farmers again. They mislead and delay until the Statutes of Limitations expires. They operate unfairly and without honoring their policyholders.

I had farmers insurance here in Washington. My home was burglarized and the robber took my car. The police found it on fire. I had an umbrella policy that included full coverage insurance on my truck which I paid on for over a year. When I was suppose to be compensated for my truck at a value between 9800-19000 I found out I was only receiving 3500 because my truck had a rebuilt title that the insurance company never told me about. They also took over 9 months to pay me which left me almost completely destitute and I had to agree on far less for the burglary as well. Farmers acted in bad faith by not paying me when they had all needed documentation. They caused me to lose what was left and this included transportation to work and my children's activities.

They refuse to pay for the damage to my car. They did not investigate the person who caused the accident even though they admitted that it was their fault. They went by the first mechanic’s report who happens to have an affiliation with person who caused the accident A Farmer’s manager told me to get a second opinion but refuse to take that mechanic’s finding sending an adjuster there who did not take any notes (just a few pictures) and was there approximately 5 minutes at the shop. Then the 2nd adjuster mirrored the 1st adjuster’s report without even looking at the damage and/or taking notes. The first report as well as the second report had flaws in it. Now it cost us $400 to have the car towed for second opinion (that the manager told me to do), $843 in car rental that they were supposed to pay for, and a car that cannot be driven. Please help me.
