Allegations of CompUSA Failing to Honor Advertised Rebates in California

The Issue
A trend has been discerned where Californian consumers are making numerous allegations that CompUSA consistently fails to pay rebates as promised in their print, radio, TV and in store advertising.

From allegations of "free after rebate" low cost item sales tactics not honored to others claiming rebates for hundreds of dollars or more that were never paid despite numerous inquiries and promises by CompUSA representatives to the contrary, there may be substantive evidence of a trend whereby CompUSA is engaging in unlawful consumer practices.

The Law as it relates to Rebates
Under California law, false advertising is a serious civil offense. Further, if a pattern of failure to honor rebates can be firmly established, it potentially brings into play both the civil and criminal implications of the state and Federal RICO statutes as well as potential violations of regulations for all the media advertising that was placed relative to the promised rebates. There is also the legal question of fraud in the inducement of a product sale to be considered in light of a potential legal remedy for consumers violated.

A law firm is actively investigating these complaints in consideration of a potential legal action along one or more of the legal concepts noted above.
