$73.4M Settlement Awarded in Boston Scientific Obtryx Transvaginal Sling Injury Lawsuit


This is a settlement for the Transvaginal Mesh Side Effects lawsuit.

Los Angeles, CA: A massive $73.4 million settlement has been awarded against Boston Scientific Corp in an Obtryx transvaginal sling personal injury and defective products lawsuit. A Dallas jury awarded the settlement in what is the first trial to go against the pelvic mesh devices manufacturer.

The jury found that Boston Scientific grossly negligent in its failure to warn the medical community about design defects of the Obtryx transvagina.

The verdict includes $50 million in punitive damages for Felix and Martha Salazar. Mrs. Salazar had the device implanted four years ago to treat urinary leakage. She subsequently suffered nerve damage and now has difficulty walking.

According to attorneys for the plaintiffs, one of the main reasons why the jury found against the pelvic mesh manufacturer is that this was the first trial in which a jury saw evidence showing that Boston Scientific was withholding information from doctors regarding a study that had been done.

The 2009 study, according to plaintiffs' attorneys, showed that Boston Scientific was concerned that long-term erosion and other problems with the Obtryx device could result in pain and difficulty having sexual intercourse. Emails were also presented to jurors showing that executives hid the study from doctors.

This week also saw a $3.27 million verdict returned against Johnson and Johnson' Ethicon unit in a transvaginal mesh TVT-O sling defective products lawsuit. On April 3, a $1.2 million settlement was also awarded against Ethicon over injuries results from the same device.
