Plaintiffs being sought for lawsuit against Yamaha

Parkersburg, WV: The Yamaha Rhino ATV has made news a lot recently due to the fact it has an increased risk of turnover. Jeff Devol who owns Devol Cycle Center in Parkersburg, West Virginia says his Yamaha Rhino customers have issues with the design of the ATVs. This has led people to the courtroom and will be leading even more people to the courtroom in the future.

Many have probably seen the ads on television and even in newspapers giving a call to action against Yamaha for the faulty design that has led to rollover accidents that has injured many and killed others. One of the states being targeted is West Virginia because of the heavy ATV use in the state. Right now, Attorney Troy Giatras out of Charleston, West Virginia is investigating a rollover case that occurred in Wayne County.

Yamaha RiderIn this case that Giatras is investigating; the driver of the Yamaha Rhino was turning around in a grassy area that was perfectly level when the vehicle tipped over. As a result of the tip over, a passenger's leg was injured. The emergency rescue team had to lift the vehicle off of the passenger's leg when they arrived.

Giatras said that initially it was thought that the case was an accident due to the driver causing it to tip over, but after looking at the case closer it appears that there may be a product liability case rather than a simple accident case.

Giatras believes that as more information about the Yamaha Rhino and its propensity to rollover comes about, more people will most likely come forward to go forth with legal action against Yamaha. However, he does state that each inquiry has to be looked at closely. But Giatras is not alone in this case because there are other firms that are investigating possible Yamaha Rhino rollover incidents in West Virginia. At the time, the Mountain State has 5 or 6 cases being looked at. Three of these cases are being looked at very closely.

The lawsuits that have been filed allege that the 2004 to 2007 models contain a defect in its design that makes it more prone to rollover when making turns. According to some of these lawsuits, the vehicle has even turned over when making turns at low speeds. The injuries that occur are broken and crushed legs, peeled skin, legs and arms that have had to be amputated and even death.

It is said that many of those who were injured were being responsible by using it for what it was meant to be used for, which is as a utility vehicle on a farm or in the woods.

Other states that have had Rhino lawsuits filed within are Texas, Arizona, Louisiana, Alabama, and Nova Scotia, Canada.
