Wrongful Death Lawsuits Filed
Denver, CO: Wrongful death lawsuits can be filed as a result of another person's negligence, malpractice or failure to act. People who have had loved ones die as a result of another person's action, or inaction, often file wrongful death lawsuits to hold the guilty party responsible for the death.
According to ABC NEWS, Wal-Mart faces a wrongful death lawsuit, filed by the husband of a woman who purchased ammunition at the store and then shot herself. The lawsuit alleges that the woman was able to purchase the ammunition with no firearms owner's identification card, which should have prevented her from being able to purchase ammunition. The lawsuit further claims that Wal-Mart failed to properly train the employee in ammunition sales.
Wrongful death lawsuits are also filed in cases involving alleged murders. The wife of a man who was shot while at work filed a wrongful death lawsuit against her husband's employers, alleging they did nothing to prevent his death. According to the lawsuit, the man accused of shooting the plaintiff's husband was repeatedly violent to co-workers, showed up for work intoxicated and threatened the deceased and his family. On the day of the incident, the victim and the accused fought and the victim requested his employers contact the police, which they did not do. The accused then allegedly returned to the site with his son and shot the victim to death. The lawsuit seeks in excess of $50,000.
Meanwhile, the daughters of a man who was killed by an allegedly drunk driver have settled their wrongful death lawsuit for $104,500. The driver of the Jeep Wrangler that hit the victim still faces criminal charges related to the incident. The lawsuit named the driver of the Jeep, his passengers and the bar that sold him alcohol as defendants in the suit.
In another lawsuit, the family of a woman who died in a jail cell after being arrested for alleged drunken driving settled for $4 million. The woman had been seen at a hospital for injuries related to a car crash, but was sent to the jail where she complained repeatedly about pain. The woman later died from internal bleeding. The settlement only affects the lawsuit filed against Denver Health Medical Center, which briefly saw the woman. A similar lawsuit filed against the city of Denver has not been settled.
The family of a man who died in an apartment fire has won its wrongful death lawsuit against the man who installed the dryer responsible for the fire. The defendant, who was also the apartment landlord, did not use a proper fitting on the dryer, allowing a cord to come loose and overheat. The family received a $350,000 settlement in its lawsuit.
