Truck Accident Lawsuit: More Accidents Every Day
Lexington, KY: A second lawsuit has been filed less than a month after a truck accident took the lives of two women in Kentucky. The wrongful death suit was filed against the a coal truck driver and the companies that operate the truck.
The victim had been in a minor accident prior to the accident with the coal truck and called the paramedics to check her unborn baby to make sure it was fine. As the woman and the paramedic stood by the road, behind an ambulance, the two were struck by the coal truck. Both died from their injuries.
This second lawsuit was filed by the father of the pregnant woman who was killed in the accident. He alleges the coal truck was moving too fast for road conditions and was carrying too much coal. The suit seeks compensation for the loss of earnings of his daughter, funeral expenses and pain and suffering experienced by the victim.
The first lawsuit was filed on behalf of the daughter of the paramedic who died in the incident. That lawsuit seeks at least $10 million.
Both lawsuits claim that M&R Trucking Inc., the owner of the truck, violated inspection and maintenance standards for the truck.
Meanwhile, in another case that shows just how dangerous big trucks can be, the driver of a logging truck involved in an accident in Canada two years ago is now in trial at the Supreme Court of British Columbia. The driver is charged with two counts of dangerous operation of a motor vehicle causing death and six counts of causing bodily harm. The accident, which took two lives and injured six other people, occurred when the truck's logs spilled over a center barrier and into oncoming traffic.
The driver was allegedly driving at nearly 120 kilometres an hour (approximately 75 miles per hour) when the accident occurred.
Many accidents involving tractor-trailers result in serious injuries to accident victims. The size difference between a passenger vehicle and a loaded semi-truck means that people in the passenger vehicle are at a distinct disadvantage when they collide with the larger vehicle. Those who survive the accident could face serious injuries, including brain, back and internal injuries. They may require specialized care for the rest of their lives.
