Avandia to Have Its Day in Court

Texarkana, TX: A lawsuit of federal proportions is pending in the Texarkana, Texas court against GlaxoSmithKline for adverse effects of Avandia. Avandia is a pill that has been used to treat diabetes as an oral method or medication. Two citizens have filed the lawsuit, a woman from Texas and a man from Arkansas.

Their allegations are that GlaxoSmithKline has been covert about the adverse effects that patients potentially face when taking Avandia to treat diabetes. The litigants of the case believe that GlaxoSmithKline release glowing words of praise about the medication, while hiding the negative information about the side effects. The woman is filing the lawsuit on behalf of another woman who was a patient taking Avandia. The woman who the lawsuit is for has passed away. The man is filing his portion of the lawsuit for himself and his own adverse effects from taking the drug.

Diabetes EquipmentAvandia received its Food and Drug Administration approval in 1999. The diabetes pill is used in concert with proper diet and exercise to treat Type 2 diabetes to rein in blood sugar levels in patients. Patients who experience Type 2 diabetes have either the inability to make enough insulin or have an impairment with the processing of insulin. The disorder itself has many other health risks imposed upon the body such as: high blood pressure, high cholesterol, kidney disease, nervous system ailments, and potential blindness. Court records show that nearly sixty-five percent of diabetic patients perish form either heart disease or stroke.

The lawsuit information alleges that insufficient information and lack of warning of the potential adverse effects of Avandia was given to patients. The litigants believe that Avandia has a faulty constitution that makes users susceptible to cardio thrombotic issues and/or potential for cardiac injury. This is in addition to undisclosed illnesses not clarified in the court files. As of November 2007, Avandia's marketing campaign was amended to include that Avandia can heighten or cause heart failure. The marketing campaign includes poor pumping heart, shortness of breath, and swelling as reasons not to use Avandia, all symptoms of heart failure issues.

If there is a lack of blood flowing to the heart it may be aggravated by taking Avandia. There is also an elevated potential for health issues in patients who are on medications such as insulin or medication that falls under the category of nitrates. Medical experts are recommending that patients do not take Avandia with either insulin or nitrate medication.

The lawsuit litigants are pursuing the recovery of damages for mental distress, economic losses, funeral costs, health care costs, pain and suffering, personal injuries, and wrongful death consequences. The lawsuit has been placed in the care of Judge Caroline Craven. The future of the case is speculated to eventually come into what is called multidistrict litigation. At that point the case would fall under U.S. Judge Cynthia M. Rufe in the Eastern District of Pennsylvania.
