Lumber Liquidators Defective Flooring Class Action Lawsuit Filed

Alexandria, WV: Lumber Liquidators is facing a defective products class action lawsuit alleging the company sold defective Chinese wood flooring that emits excessive levels of formaldehyde.

Filed in the U.S. District Court for the Eastern District of Virginia, the lawsuit states, "Indeed, contrary to Lumber Liquidators' repeated, detailed representations that its flooring complies with strict formaldehyde standards on its product labels, website, and elsewhere, the toxic formaldehyde emissions from the company' Chinese flooring products are multiple times the maximum permissible limits set by those standards at the time of purchase."

In 2011, formaldehyde was described as "known to be a human carcinogen,"by the US National Toxicology Program : a carcinogen is a substance or agent suspected to cause cancer.

The plaintiffs, Donnie Williamson, Melissa Stini and Jennifer Hogencamp, further claim that the floor is illegally sourced through China from other countries, including Russia, threatening "critical habitat and endangered species."

"Plaintiffs would have paid significantly less, if they purchased Chinese flooring at all, had they known that the products were sourced from endangered habitats and contained elevated levels of the toxin formaldehyde,"the lawsuit states.

The plaintiffs contend their flooring purchases — all of which were installed in their homes — are now "markedly less valuable."

The plaintiffs are seeking damages for installation and removal costs, remediation costs, restocking fees, loss of use and diminished value, in addition to attorneys' fees and costs, and pre-judgment and post-judgment interest "at the highest rates allowed by law"on the damages awarded.

We installed the morning star bamboo flooring 5/15. The flooring is splitting/cracking, finish is coming off and scratches very easily. The flooring was professionally installed on new underlayment and morning star glue. We also are actively seeking a class action lawsuit as we have over 10k invested and are at the point we just want it ripped out of our home.

We purchased Morningstar bamboo flooring from Lumber Liquidators last year 11/15 and have nothing but problems. Shrinking, splitting. It is a mess. We are retired and have limited means had I know we have been taken. I have no idea how to join this suit, but I want to.Please help me. They sent someone how to say it was the installers fault. It is not. It is a product deficiency.

We installed about 100 sq feet of the defective flooring a year ago. Since that time my son and husband have had numerous respiratory issues which were not present prior to the installation. We want LL to pay to remove and replace flooring including all labor costs. Has anyone had any luck with getting anywhere in regards to having someone contact them or get reprieve from the problem. LL is no help at all!

We have those bamboo floors. We have sore throats and sinus problems. The floors are coming up and they are splitting apart in inches and gaps.

My son has been sickly for the last four years. We never considered the flooring could be the cause or a part of his illness.

My husband purchased/installed Morning Star Bamboo Flooring in our home. I have been sick to my stomach, headaches, fatigued. Been to my doctor. Contacted Lumber Liquidators regarding fumes emissions and they’ve ignored us. Please include us in any action. Purchased April of last year. Approx. 1,000 sq. ft. of materials.

Purchased 900 sq. ft. of "Lake Toba Teak 7.5'" in 08/16/14 for 2nd floor apartment. We have been coughing a lot. My husband and I are both sensitive to allergens. We want Lumber Liquidators to remove present
floor and pay for a new floor to be installed that meets the California CARB
restrictions purchased elsewhere. We have purchased an air cleaner hoping that would help. It has not. Thank you
