While sitting in my car at a Taco Bell parking lot with my car off, a Moffett Mounty forklift lost its hydraulics on a hill across the road and crashed into my car pushing me back 6 parking spaces leaving the forklift pushed up on my car and totaling it. The driver of the forklift said Moffet's forklifts frequently lose their hydraulics and brakes and he had gone over a cliff the last time the hydraulics went out. Three months after our claim was filed Moffett had a (national?) recall of all their forklifts to repair their hydraulics.Submitted 2008-07-28Defendant: ^Defective product causing personal injury My 2006 Toyota Corolla was totaled. I was injured and required chiropractic laser treatments and adjustments for five months. My injuries were not severe but pain and soreness in my neck required treatments three times a week. The insurance company for Grassy Hardware (Defendant) paid to replace my car ($13,500) and another $8,000 for medical and other damages. Moffett Mounty was not involved in the claim or settlement. I believe Moffett knew about this hydraulic defect for many years but did nothing about it. -- North Carolina * The views printed here do not necessarily represent the views of LawyersandSettlements.com but are solely the views of the author.
