Bank Overdraft Fees Regulations

Excessive Bank Overdraft Fees Under recent changes in the law, a bank cannot charge overdraft fees on debit purchases or ATM withdrawals unless the consumer specifically agrees. Federal rules that took effect in 2010 no longer allow banks and credit unions to charge overdraft fees on ATM or debit card transactions unless the bank customer agrees to "opt-in" to overdraft protection. However, banks and credit unions are still allowed to charge when checks or certain recurring electronic payments overdraw an account, even when the customer didn't opt-in to overdraft protection.

There is no legislation regarding how much money can be charged for overdraft fees, meaning customers who opt into the program could still pay up to $35 for transactions that take them even $1 into overdraft.
 

Overdraft Fees

Overdraft fees are charged when customers attempt to conduct a transaction from their bank account that they do not have the financial means to cover.

Bank accounts go into overdraft when more money has been taken out of the account than was actually in it. It can happen quite easily: a bank account has $100 in it, but the customer makes a debit card purchase for $110, pushing the account $10 into overdraft.

Consumer Financial Protection Bureau reported in 2013 that 61 percent of bank profits from consumers come from overdraft and insufficient fund fees.

Bank Overdraft Fees The problem is that some customers say they never asked their banks to provide overdraft protection they assumed that if they tried to make a purchase they could not afford the purchase would be declined. Instead, customers say more and more frequently, such purchases are being approved and the customers are left with hefty overdraft fees.

Those fees can be as much as $35. That means that $10 into overdraft—overdraft the customer might not have asked for—is costing that customer an extra $35. What's more, customers say they are charged overdraft fees for every overdraft transaction. So, they may be in overdraft without knowing it, continuing to spend on their accounts and being charged $35 every time they do so—pushing them even further into overdraft. That can add up to hundreds of dollars in fees.
 

Excessive Bank Overdraft Fees

According to a December 2016 Consumer Protection Report published by the US Public Interest Research Group (US PIRG), 626 large banks reported collecting $8.4 billion in revenue from overdraft and insufficient fund (NSF) fees, an increase of 3.6 percent over the same period the previous year. Some of the nation's largest banks, along with some smaller institutions, accounted for 67 percent of the total reported overdraft revenue.

According to the US PIRG report: "The 10 banks that collected the most overdraft revenue through the first three quarters of 2016, in order, were: Chase Bank, Wells Fargo, Bank of America, TD Bank, US Bank, PNC Bank, Suntrust Bank, Regions Bank, Branch Banking and Trust, and Woodforest National Bank."

In 2015 the three largest banks collected $5.1 billion in overdraft fees alone. The average overdraft fee is $34 dollars, but according to a 2014 report from the Consumer Finance Protection Bureau (CFPB), the majority of debit card overdraft fees are handed out on transactions of $24 or less and are repaid within three days.

Put in lending terms, if a consumer borrowed $24 for three days and paid the median overdraft fee of $34, such a loan would carry a 17,000 percent annual percentage rate (APR), the CFPB noted in 2014.
 

Excessive Bank Overdraft Fees Lawsuits

Excessive bank overdraft fees lawsuits have been filed and/or settled against a variety of banks, including Wells Fargo, Bank of America, M&T Bank, HSBC, UMB Bank and Wachovia. The lawsuits allege that banks charge excessive overdraft fees when customers' accounts go into overdraft. They further allege that the banks use a number of unethical practices to push their accounts into overdraft, such as misrepresenting customers' account balances and reordering debits and credits to accounts.
 

Reordering Transactions

One tactic that banks are accused of using to increase their profits from overdraft fees is reordering transactions on accounts. That means that regardless of what order transactions occurred in on a single day, some banks process the largest transactions first. That can lead to a lot in extra fees for a person to pay.

For example, say a man spends $10, $20, $50 and $100 (in that order) in four transactions on one day, having $140 in his account. Either way, the account will likely still go into overdraft. But, if the account is debited in the order the purchases occurred, then only the final transaction will result in an overdraft fee of $35. However, if the transactions are processed from largest to smallest, then only the $100 purchase will be covered, leaving the customer to pay $35 for each of the final three transactions—for a total of $105 in charges.

Not all banks charge a flat $35 overdraft fee. Fees run from $19 up to $35. Some banks have tiered overdraft fees, so that the first overdraft transaction in a certain period costs one amount but any more overdraft transactions cost more.
 

Authorization Holds

Overdraft Authorization HoldAnother practice that banks are alleged to have used to push customers into overdraft is authorization holds. Authorization holds occur between the time a bank card purchase is made and the time the merchant settles the transaction. Prior to the merchant settling the transaction, the amount of the purchase is held, but it has not actually been withdrawn from the buyer's account yet. Once the merchant settles the account, which can occur a few days after the purchase is made, the funds are transferred to the merchant and the customer no longer has the money in his account.

For example, a customer with a $100 in his account makes a purchase of $40. That $40 is held immediately for the merchant, but is not actually taken out of the account because the money has not yet been transferred to the merchant. The customer cannot access this money, but it is still, technically, in his account. When the merchant submits her batch of transactions, the money is then taken from the account and transferred to the merchant.

This is all completely legitimate. However, some customers have complained that their banks back-date transactions to the date they occurred, not the date they were settled. They say this pushes their account into overdraft because they may not have had the funds necessary on the date the transaction occurred but did have the funds necessary by the day the transaction was settled.
 

Irregular Deposits

Irregular DepositsAnother complaint is that banks have been irregularly posting debits and deposits on customers' accounts. For example, banks are required by law to make a check deposit available to a customer within a certain number of days. However, they can choose to make the deposits available sooner. Customers have complained that check posting is occurring inconsistently meaning that customers cannot predict when a deposit will be posted to their account. Sometimes, they say, the check is posted immediately while other times the check is not posted until after the account holder goes into overdraft.
 

Credit Union Excessive Overdraft Fees Lawsuits

Credit unions, which are not-for-profit organizations run cooperatively by members, operate differently than banks but may still face similar legal issues as banks such as lawsuits claiming excessive overdraft fees. According to the Credit Union Times, a wave of overdraft lawsuits has struck credit unions across the country.

"At least one dozen credit unions in nine states have been hit with class action lawsuits over their overdraft practices, Credit Union Times reported in Jan. 2016. "Often, the dispute is over how credit unions disclose the methods under which they apply overdraft fees."

In Nov. 2015, Tracy Fry, a Florida resident, filed a federal class action lawsuit in US District Court, Middle District of Florida, Tampa Division, against MidFlorida Credit Union, alleging that the credit union abused overdraft policies, breached its contract with members and charged customers overdraft fees when they had sufficient money in their accounts to cover the transactions.

Annual Pew Charitable Trusts Bank Evaluation

Since 2013 Pew Charitable Trusts has outlined its set of best and good practices for overdraft services in 2013 and has evaluated banks each year since to track the practices of the largest 50 banks that offer consumer checking accounts. According to Pew, since it began examining overdraft issues, the largest banks have adopted many of Pew’s good practices, but few meet all the best-practice standards, especially with regard to declining ATM and debit point-of-sale (POS) transactions.

A recent study found that the largest percentage of bank overdraft fees are collected from bank customers who earn the lowest incomes. According to a 2016 issue brief from Pew Charitable Trusts, consumers often incur unexpected overdraft fees that exceed the original transaction amount.
 

TD Bank Overdraft Fee Lawsuit

Consumer protection attorneys are investigating claims that TD Bank charges excessive overdraft fees through a trick called ordering. Anyone with a TD Bank checking account who has been charged multiple overdraft fees on the same day may have been charged these fees improperly and may have claims against TD Bank.

TD Bank allegedly changes the ordering to cause the consumer to overdraft their account multiple times in the same day, when really they didn’t overdraft.

For example, say you have $50 in your checking account and make purchases of $10, $20, $15, and $100 in that order. You have only gone into overdraft on that last purchase. But TD bank has been accused of this” ordering” by processing the $100 charge first, and causing four overdraft fees.

TD Bank has 1, 301 locations, including branches in Connecticut, Delaware, Florida, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, South Carolina, Vermont, Virginia, and Washington, D.C.
 

TCF National Bank Lawsuit

In Jan. 2017, The Consumer Financial Protection Bureau (CFPB) filed a lawsuit against TCF National Bank, accusing the bank of obscuring fees and adopting a loose definition of consent to preserve overdraft revenue. According to CFPB, TCF designed its application process to obscure the fees and make overdraft seem mandatory for new customers to open an account. Further, TCF allegedly adopted a loose definition of consent for existing customers in order to opt them into the service and pushed back on any customer who questioned the process. The CFPB lawsuit seeks redress for consumers, an injunction to prevent future violations, and a civil money penalty.
 

Bank Excessive Overdraft Fees Settlements

In May 2017, a hearing was slated for final approval of a $7.8 million settlement in a class action Ratzlaff et al v. BOKF, NA et al, Case No. CJ-2015-00859, Tulsa County District Court against BOK Financial (BOKF)with former bank customers who claimed the bank charged them excessive overdraft fees.

In July 2011, Fifth Third Bank agreed to a settlement of $9.5 million in a class action lawsuit Shannon Schulte et al. v. Fifth Third Bank, Case No. 0:09-cv-6655, US District Court, Northern District of Illinois, Eastern Division filed in November 2009.

In the lawsuit, Fifth Third accountholders claimed that Fifth Third Bank improperly assessed overdraft fees for insufficient funds on debit card purchases and ATM withdrawals by "re-sequencing" the order of transactions to maximize the number of overdraft fees.

Various banks have now settled lawsuits alleging they charged excessive overdraft fees or reordered transactions to push consumers into overdraft more quickly. The following banks reportedly agreed to pay:
  • Capital One: $31.8 million to settle allegations of deceptive overdraft practices.
  • American Savings Bank: to settle a class action lawsuit filed against it for $2 million
  • HSBC Bank USA: to settle overdraft lawsuits. HSBC Bank USA's settlement will see the financial firm pay $30 million to settle claims.
  • Bank of America: $410 million to settle claims of more than 13 million customers that the company used unethical overdraft practices. (Plaintiffs in the 2011 class action lawsuit alleged that Bank of America processed its debit card transactions in the order of highest to lowest dollar amount in order to maximize profit collection from overdraft fees, which were usually $35 each.)

My bank has placed nearly $900 in fees in one month on my account. I’m a single mother of 3 in RN school. I’ve never asked them to waive a fee before at $30.00 a fee. I’ve banked there for 3 years and 6 months ago my transaction would be there then they would disappear, a large charge would go through the next day then the transactions were back right on top where I now get 3 fees instead of 1. This has continued to the point I can’t correct the account anymore without losing my home.

M&T bank with hold transactions in pending, then push it through backdating the charges so they can charge their exorbitant overdraft fee of $38.50; one of the highest fees in the industry. I have caught them doing this and I have actual screenshots.

They have probably charged me thousands of dollars gaslighting me like this. And if they've done it to me, they've done it to others.

I guess the CEO needs a third yacht, am I right?

Bank Of The West loves to hold paper checks and not release funds in their entirety for days, sometimes forcing a struggling individual to go into overdraft because they can't get their own money on time. And even better is when you're really struggling, wind up in the hole more than 5 days, and get a fee of over 100 dollars on top of it. I understand basic fees as a deterrent to not have everyone using more money than they have on a regular basis, but over a hundred bucks just because? I'm done with BOW

I have been got with hundreds and hundreds of over drafts most often response from the bank was "we don't know how that happened? " shortly followed by we can only refund three of then at the max. So I was still hit with the other 12 fines. It is a croc of shit. I have all the documentation I need. Over 4k I'm the past year alone!

I am part of this class action settlement.I have to say that I hate TD bank with a rage.I read on the website that since the settlement was approved at the 70 million price tag and everything has been considered I and every one else who is to get a payment may start receiving them next month.MY reason for hating them is due to a mistake I had made.The ad on Craigslist said they could help me get a grant.Like a fool I fell for it.I went to the precint and they told me not to ever fall for schemes like that again and to get reports and stuff.TD Bank does not investigate any type of fraud.They hate you the consumer.They love their shareholders over you.In my case they treated me worse than gum on the bottom of your sneakers.They will get more lawsuits.Someday like those who are on the left side of the political spectrum say they will be broken up.

Suntruust bank on a $10. Transaction charged me $3600 fees on the 22nd and extended fees on 28;/January 2020;;;$36::total $72. Sunmark Credit Union, formerly Sunmark Federal Credit Union recently became NYS chartered. I'm not certain about the ramifications, but having been a state employee years ago, I had a bad feeling about this, given the levels of beauracracy and incompetence. Having been a consumer of Sunmark for 17 years, I have never had a problem with them. As I opted in for overdrafts , I occasionally have used that privilege knowing full well there will be a $30.00 overdraft fee. These occurrences were almost always intentional as I rarely make errors in calculating my balance. My federal paycheck is direct deposit. For the past 17 years it clears from "pending" to "available "at 8:00A.M. the day after deposit. Recently my son took my car for repairs using my debit card. He waited until 8:15A.M.for my deposit to clear , to make withdrawals . Well, I was charged 4 overdraft fees , $30.00 each for each transaction including separate overdraft fees for each $2.75ATM charge even though the ATM fee and withdrawal are one in the same transaction. I called the credit union and was informed my deposit didnt clear until 8:20 A.M .
How convenient, 5 minutes after the transactions! The teller informed me "We have until 9:00A.M. to post your deposit". She agreed to waive one fee as a courtesy. I insisted on all of them being waived and finally she spoke to her "overdraft manager" who agreed but she warned me they will no longer be giving me this courtesy. I think they did this for me in the past when my acct. went over by a few cents.
Again, I do not fully understand this state charter, but as my intuition said, it cant be good. Sunmark is like all these other banks listed here, in my opinion. Imagine charging overdraft fees for the measly ATM fee as well as the ATM withdrawal . That angered me more than any of this, yet all the while , there was a federal paycheck of almost $2000 right there in my acct. just waiting to post. I will definitely be changing credit unions in the near future.

I bank with Suntrust bank, and still up to this date. However, they have charged me overdraft over overdraft all the time. They have used every single possible trick there is out there, and when I call to ask about the issue, they treat me awfully, discriminatory and disrespectfully. The few time they help me out after I have argued with them for a while, they said that they have not make any mistake, but because I’m their client, they are going to give me a courtesy refund....
I am really hoping we can gather a group of customers from the same bank, to create a class action lawsuit against them.

I deposited money in my account and immediately withdrw 100 from the ATM at the bank, I used my card all weekend and on Sunday I checked my balance and had 65 left in the bank. I withdrew 40 and put 15 in gas using my card my balanced showed I had 7 left. Next time I look I was -116 it showed the 100 withdraw from the atm. My ATM withdraws always show up right away is it on me or them since they had my balance wrong. We paid the 116 back but is there a way to get reimbursed. I do online banking every swipe shows up automatically. So what can I do and are the liable. My account would not have been overdrawn if they would've not messed up.

I bank with Bank of America since 1990 and still with them. They would not deposit my deposits and charge my account for Debits first then it would overdraft my account and for each debit that was not covered they would charge my account with overdrafted fees. So then my deposits would not count.

Bank of the West will approve debit card transactions even when you have declined overdraft protection in order to charge you excess fees. When I called to inform the rep of the regulation D violation, the CSR refused to refund the fees. I am now having to file a lawsuit in small claims court with Bank of the West.

I deposited a check to my bank account with Commerce Bank and it was completely cleared (not pending) to my account on 10 October 2019. I made a few online transactions and a in store purchase with my debit card (after my online banking showed the money cleared in my account. These purchases were not going to be more than I had in my account.) The evening of 15 October 2019 my debit card was declined. I checked my online banking and there was an “exceptional item hold”. The next day the bank returned the check amount but did not put the purchases I had made prior to the hold through until after they returned the amount. I went that day to make my account positive and talk to someone about what took place. I would never had made purchases with that account if I had not had the money cleared in my account. Now Commece Bank is charging me an excessive amount of over draft fees totalin over $160. When I asked them why they cleared the check to my account I was told it was in “good faith” and I should have known better and I should know who I’m doing business with and pretty much I need to accept the charges as a lesson learned. I have a screen shot showing the purchases pending to my account dated prior to the “exception item hold”.

I overdrafted my USBank account by a single purchase, and was charged four overdraft fees. They charged me an overdraft fee for my account balance less the pending transaction, which is fine, but then their overdraft shoved my account balance into the negative, and they decided to charge me an overdraft for two other 5 dollar purchases that I had made well in advance and were already in my pending transactions, as well as the item I purchased, causing two charges that would never have happened without the first overdraft, and overdrafting me a second time on the same item. USBank WILL rearrange your pending transactions to maximise the total number of overdraft fees they can hit you with if you ever overdraft your account, period. It should be illegal for them to overdraft charge you before pending transactions transpire for this exact reason.

I honestly forgot to subtract a debit that was made at store and got an overdraft, I check my account regularly and saw the overdraft I immediately made a cash deposit that same morning and then another check deposit later the same day. After I made the deposits there was a large positive balance. The next day I checked to see what cleared and saw that I was being charged 2 more overdrafts one for 33.00 & one 2 tier overdraft for 38.50. I immediately called key bank customer service and they tried to tell me these were for debits that came through that day. The balance was positive how could this be but after the bank updated that night they added the overdrafts which changed the balances but I still had a positive balance. after a long talk they agreed to waive the fees ( not the first one). The next day I checked to see what cleared and I see 3 more 2 tier overdrafts. This makes no sense so I called c/s and they tried to tell me the fees were for transactions from the previous day the same day I had called to have fees waived and had a large balance. There is something definitely wrong with the way they do things. I wish I would have screen printed everything from each day. After a half an hour they finally waived the fees but that never should have been charged in the first place. So for a small error of less than $20 that was made good the day after it happened they charged me 2 $33.00 & 4 $38.50 overdrafts for a total of $220.00 over 3 days. HOW IS THAT LEAGAL!

I was out of town in Canada. No one told me about the "exchange" fee when using the debit card. As a matter of fact, the last time I had used it when out of the country there wasn't one.
I had money in the other account that is linked to this account. There was more than enough money to cover any charges. Instead, however, they put these measly charges onto the account, didn't move the money over, as they had before. Didn't inform me that there was an overdraft until this morning, which is 2 days later, and then there was $360 in overdraft fees for an over draft of $200 total, which was an additional overdraft due to the original overdraft fee. No email. No phone call. Nothing until they had charged me.

I have had nothing but issues with Wells Fargo since I signed up! They are constantly declining transactions because of holds they place on my card every other day and also when I don't have enough funds. Well I have two open checking accounts with them. I was running low on money so I transferred my funds from one checking account to my other one because I knew a auto debit would try to come out but I needed money for gas. I assumed that Wells Fargo would decline the charge and I could just pay it when I had the money again. Well for some reason they let this charge go through - returned it - and charged me a fee for the return. They also went ahead and charged me three overdraft fees for transferring my funds from one checking account to another. Is this even legal? How am I getting charged with overdraft fees for transferring money from my account into MY account? They never let purchase go through if I don't have the money any other time but this time they do so they can get money from me? And then charge me three more? I'm almost up to $200 in fees because of this crap! I'm about to close my account and say screw the fees and Wells Fargo because I HATE THIS BANK!

Synovus took over for Florida Community bank. During the merger online banking and mobile deposits were unavailable. Causing deposits not to be posted and in turn creating over drafts. The bank also seems to pool transactions together and instead of processing the transactions consecutively as they come in. They will process the larger transactions first. This depletes available funds which in the situation of over drafts creates multiple fees for the company as opposed to just one fee. Lets say you have $1000 in your account and you have 10 transactions of $5. Then you have one large transaction of $999. They will process the larger transaction first. Which depletes available funds and collects the company 10 over draft fees. This practice coupled with misleading policies on when funds will be available after a deposits; leaves customers guessing when money is available. They claim two days. But in reality it is more like ten days. Which is fine. Just say that it will be ten days.

B of A charges me overdraft fees on pending transactions. For example, Pending transactions are deducted (such as a hotel) for an amount. Then the amount changes, but not before a check comes through which gives me a fee for nsf. When the pending transactions finally goes through the nfs fee is what makes my account negative. Yesterday BOA put a 9 day hold on my personal check that I deposited for $1,100 into my BOA acct. My personal check cleared my Chase bank today(the next day), but BOA is still holding the check captive and has not cleared my deposit. When I deposited by phone, BOA receipt showed that it would clear the next day, then I received an alert that they are holding the funds for at least 9 more days.
I need my deposit released by BOA and funds available immediately to pay other bills. BOA is playing with the float. I called BOA and they said there is nothing they can do until they hear from Chase. I called Chase and they said my account is fine. The check cleared Chase and they have received nothing from BOA asking to verify that the check is good. I am self employed and BOA is causing a hardship for me. I have been a customer with BOA for over 20years. A lawsuit is needed for the banks to give the option to void the phone deposit if it will take longer than the regular deposit time 1 to 3 days. I called and asked them to void the deposit once I received the alert (that it would not clear in a day or two) and BOA said there was nothing they can do. I asked them to call Chase to verify my personal check I deposited into my BOA personal account cleared and they said they don’t do that. Yesterday after I received the alert, I could have ran to Chase to withdraw the cash needed to cover my mortgage payment but then the Chase check would have bounced. So I had to borrow $1,100 to cover my mortgage. Now the $1,100 BOA put on a hold for 9 days is causing a hardship On me and I am unable to pay my utilities and now they are about to be turned off.

Wells Fargo is very deceptive, especially to the less vulnerable. I'm currently 18, just graduated high school last year, and before college started my dad gave me a debit card to use for college. Everything was going well, till about a week ago I realized I'd been hit with 3 "overdraft" fees. NOT a day IN my life have I ever heard of this word. My understanding, from high school, of a debit card is you put money into an ATM, that goes into your card balance, and then you use money. NOT ever did I hear of "borrowing money". WHY would I need to borrow money at this young age?!?! If my account reaches 0, CANCEL everything I try to pay for until I have the sufficient balance for it. If I wanted to borrow money I'd use a credit card for christ sake, this was the difference between debit card vs credit card I understood from high school. The deceptive thing however is, a couple months ago, I went to a chinese food to order food and swiped, and when I swiped the screen say "insufficient funds, invalid", turns out I didn't have enough money in my account. But for someee reason, a week ago when I swiped for a membership at the cost of $5 it went through, so I incurred I had enough money in my account, otherwise it would have told me "insufficient funds, invalid", like it did a couple months ago, BUT instead Wells Fargo let the transaction go through, and next thing you know, something that cost $5 is now costing me over $30, makes no sense to me. It's not even A NEED. This is deceptive practice to people of all ages. Now I have to explain all of this to my dad, I don't know how but hopefully it goes well. To Wells Fargo, LET me opt out of this STUPID program. For some reason, I am not able to. ALLOW THAT please. IF I'M AT 0, LEAVE IT AT 0, CANCEL ALL MY PLANS.

Seven checks mailed at post office have gone missing. Went to bank to stop payment so I could re issue payment and not be late on bills due. My bank has been in a lot of trouble lately for various practices. They want to charge me $35 per check to stop payment! That is $245. I am the victim here! I could understand that if I was stopping payment for other reasons that were partially my fault. I am a senior on a fixed income and barely make ends meet. Now in order to pay my creditors, I have to without food and needed meds in order to pay my bills. In today's world victims get punished and predatory practices get rewarded. I'm glad I'm almost done with this world.

I believe there should be more flexibility with overdraft fees as I know I have been told from my bank they have NO way of controlling debits and credits coming through. Wrong. An auto debit for a bill came out on Christmas day but my direct deposit didn't go in my account until the next morning at 5 am. I was charged a $30 fee for this and when calling the bank they let me know they have been generous to me already when I had asked for reversals for the same reason in the past. I let them know that I only have control over my account to prevent this and out of the $$$ amount I had already paid to them the amount reimbursed was not that much. I had said that I was not asking for it back due to a mistake on my part but due to a debit coming out when the banks are closed but the debit not going in until the bank was open the next day. Sometimes the overdraft fee is applied a day later so I have time to transfer money before this happens but sometimes they attach the fee right away? I also had to pay a $30 charge for a payment being taken out incorrectly by my credit card company told that it is a process for them to do so but while on the phone it was done in about 5 seconds by the representative while on the phone with me. So just today alone I have paid the bank $60 and because they reimbursed me a total of $ 120 in the last YEAR, they would need authorization from management to do this! What the heck?! Why are we not fighting this!? WE PAY THEM TO BE IN BUSINESS! WITHOUT OUR MONEY THERE WOULD BE NO BANKS AT ALL!!!!!!!

Regions Bank is killing us in overdraft. The amount in 3 yrs time is in the multiple of thousands. They seem to kick back big purchases but anything from .30 cents to $3 they will let come through so each and evey one gets a $36 overdraft fee. Every two weeks we pay around $400 + in overdraft fees, it's hard to get away from and these banks know this. It's a very vicious cycle. So seems we're stuck. These banks should be ashamed of themselves!

First National Bank Texas charged my mom's account $35 every fourth day in the middle of the month because of a $20 miscalculation dragging it into negative. It cost $140 in fees and bounced her house payment because it was not the first item. She is on SSA with a fixed income.

NSFs are designed to extract capital from the poor through bogus excuses known as "policy". The fact they make more than 25% of their net profit from this is asinine. Why can't ZERO mean ZERO? If the money isn't there, say there isn't. The cost to check an account to see if it has enough of a balance to cover a cost is nothing to the banks.

Any BBB member that is a bank which conducts business like this should lose their status, and all insurance companies should therefore stop insuring them.. for anything! See how that shit works. (Not talking about FDIC)

Arvest Bank needs to be on this list. They do not process transactions in real time. They process in a specific order with debit card transaction being first and DDA ACH (bill payments) done last. Because of this they unfairly charge overdraft fees. I recently checked my account online. I had positive balance and the outstanding DDA ACH were pending and their amounts removed from the balance. Later that afternoon I made a purchase that overdrew the account. I expected that overdraft fee. What I didn’t expect was the 5 other charges for the pending DDA ACH transactions whose funds were already out of my balance. When I inquired, Arvest told me how transactions are prcoessed and I was actually told it was NOT in real time. So it doesn’t matter which transaction occurs first. They provided time stamps for the debit transactions but would not for the DDA ACH transactions. Clearly they are trying to get as much money as they can from their customer!

I have been with Pnc for 7 years. I had a payment come out of my account that was via checking account. I checked my account and sure enough it came out a couple days after i paid it. Well it overdrew my account so I stopped at the atm to deposit the money in so when i got the receipt it said i was positive 17 cents. I was like ok i'm good. The next day I got an email saying my account was overdrawn again. I was like this can't be right so I checked and gas that I had gotten a week before just came out so I ended up getting charged the 36 dollars anyways. I wish they would have given me time to get the money into my account so now im in the hole 45 dollars. This isn't the first time it has happened to me.

if any one is successful in a lawsuit with BBT please add me to it. I paid them to stop payment on a check and they did not do that, the check was to my landlord and he bragged how it was good to have friends in high places so the teller honored it anyway. Also when they first took the money I surely called spoke to many people and lo and behold I got a personal call from the actual teller who cashed it. She apologized over and over to me about it and told me the money would be put back stat. I am on low fixed income so them taking the 450.00 out would have been completely and totally devastating and I have 2 kids to raise on what I get only once a month. They did put the money back and I was so relived. I turned around couple days later they had took it again, then they would not ever again let me speak to the teller who had called me. I could tell by the time I called them back the second time, every employee, supervisor, manager, even the chief executive was all on the same page. I even sent in a very long letter and print offs of it all to the CEO and they too told me they did nothing wrong or illegal. Now the bastards are trying to put a judgement on my credit file of over 700.00 which is the check and fees etc. they claim they had paid some other stuff too for me. I have worked for years to clean up my credit file and finally got every bad mark off but one and its coming off next year. Only to have this bank add that one will put me and all my hard work on my credit right back at square one. Anyone who knows how hard it is to get your credit straight will relate to just how damn mad I am right now. However I can not afford a lawyer much less one of the caliber needed to go up against such a mega super size bank such as BBT. I will surely lose because I am a nobody and I think BBT knows that.

My husband has been with iberiabank for right at 20 years I have been with them right at 17 years. He opened up an individual checking account in 1998 and I came along 2003, anyways we've been with them for a long time. Before we lerft iberiabank we were paying about $6000 per year in Bank fees. ?I have bank statements going back to 2003 and the first 12 or 13 years were pleasant, but after that it went to hell. Within 1 month of my branch closing, i was called by a store or something and they had one of my checks. I told them I would pick it up and called the new branch. i told them do not send my checks back. There is $15000. deposited in this account every month and has been for 15 years. That was when i was told that they would accommodate my needs. i was approached by the branch manager and she wanted us to refinance with a heloc. She told us the line of credit will help allieveate overdraft fees. We were both very apprehensive about it for many reason, but went ahead because our banker seemed trustworthy.
we closed on our loan, and the first time I tried to use our heloc, she chuckled and said no Mrs Brockman, before you can use your credit line you have to pay down the interest. So Heloc was absolutely no use to us, in fact, we are now in default on the loan and all our equity was gone. The heloc was a very very bad decision on our part.
Moving forward, my husband works in the oilfield and it was in a downturn. During this time we lost 60% of his income. The first month that we saw the reduction in income I was negative over $2000 in my account. i had paid my bills like i normally do and then set up 3 transfers to an external account. Iberiabank canceled the 2nd 2 transfers and paid the first one to my other account and returned every bill payment I made. They moved the transfer in front of everything. At that moment our credit was ruined, our credibility went to shit and it happened to be December 2015 so our kids Christmas was nonexistent. We had been paying the overdraft fees to this bank to the tune of $6000 in 2015. I went in on many occasions to try and get relief and one time the area manager commented that we sure had a lot of money going in and out of our account. That was a very inappropriate comment, in light of her position. When I had finally had enough, i told the area manager that I would be hiring an attorney. My account was great as long as i kept my mouth shut and kept bouncing checks. The moment I said attorney it changed. I received a letter stating they would be canceling our acct in 30 days. in the mean time, I went to drive through and they would not cash my check because it was written in the wrong ink. This bank has never been to grocery store with me and have always cashed my checks. So all in all this bank has destroyed our lives and everyday we are still fighting to put the pieces back together.

I rented a car from Avis car rental they took the funds from my account but they should have charged another credit card. I caught it and went to Wells Fargo and they gave me a provisional credit and Avis credited my account back Wells Fargo took the provisional credit from my account witch made my account over 1600 negative, I get disability deposited can Wells Fargo take all of my disability payment to pay back the negative balance?

Suntrust has been charging my overdraft fees on positive debits. When I call of send them a message SOMETIMES they reverse the overdraft fees, sometimes they don't. I need a lawyer. This always happens 8 days or so from payday so they get me again after seven for extended overdraft fees.

My best suggestion to everyone is not to use these bankcards except for airline tickets, car rental, hotel and emergency and go to using cash and take out enough to cover you for the month. Instead of checks use money orders. I've had the same problems as everyone else here. You will be amazed to find what you have leftover at the end of the month

I got paid on 7/20. Did some shopping. Friday, I had about $44.34 left in my account. My spouse took $40, leaving $4. and change. I was okay because the money from purchases on 7/20 the bank deducted. We went into overdraft when he went back and got $40.00 2 separate times on 7/22. Therefore that left us w/ around $80 over what we had in our account. The bank manipulated the account even after they were deducting as I made my purchases. Some were debit purchases and some were credit purchases. They were still deducting on 7/20, so I believed the balance was correct. Checking my account on Tues. 7/25. The bank had reorganized the transaction to appear as if they were not purchased on 7/20, but on the 22, 23 or 24th. For every single transaction that was made on the 20, I received a overdraft fee of $29.00. Putting my account in overdraft for $283.00. I knew about the 2, $40 transactions, for a total of $80 + $58. =$138. This is what I figured I will owe. Not $238. I went to speak to the banker, SCTelco, here in SC. The banker stated it's not the banks fault because the merchant demanded payment 3 days later. The merchant did not put request payment on 20th.

Could anyone let me know what options I have if my bank continually charged me OD and late fees that were not sufficiently communicated to me?

The bank I used to work at, no less, has hit me with a ton of these charges (upwards of 900) and are claiming they did their part because they sent me one notification to my permanent address which I gave them coming straight out of college.

It had been 45 days, and I only found out bc I called them!

The worst thing, which compounds these NSF charges is the ripple effect it causes to our credit with other parties. Additional fees charged by the check recipient, loss of payment options from them requiring more expensive payment methods (cashier's check, cash, or wire) all cost additional monies in perpetuity. The banks should pay the fees back, plus the fees charged by the third parties, plus write letters to each and every party admitting their wrongdoing and finally significant punitive damages. Their upside is they are making tens of billions of dollars a year (according to PEW research). Our upside is we get to pay our bills and live our life without excessive costs or stress.

My issue is also with PNC. I was just charged 3 OD Fees, when looking at my account it should only have been 1. Apparently, an item was "pending" so, they held those funds back. 2 items actually posted to the account. because of the "pending" charge, they said the money wasn't in the account to cover the charges that actually posted to the account. charged me $74 on less than $20 for those two transactions.
THEN, when the item that had been pending posted, of course the money was no longer there because of the OD fees, so they hit me with another. I contacted them to ask about this, and the woman just kept telling me I could "opt out" of overdraft protection. Why, when they'll still charge me $36 NSF fees, and NOT pay for things? I just want them to release MY money when things actually come out of MY account!!!

Yesterday I checked my balance in my account and I had 14 pending transactions, both Debit card & auto bill pay. After all those transactions were showing pending I still had a positive balance in my account. So I did not overspend. When everything cleared my account overnight a tenant's rent check they wrote to me 2 weeks ago came back on my account as a returned check-NSF. They withdrew that check first and caused all 14 already pending transactions to bounce! I ended up with $465 in fees and my direct deposit paycheck went in this morning brought everything to positive before 7am and they still charged me all the fees! Had they posted the returned check last it would have been the only thing to draw negative and charged one fee and my paycheck would have cleared it all a few hours later! This has to be illegal. I signed opt out but because the returned check wasn't in my account when I spent money everything cleared and nothing was rejected!

I bank with PNC and have an automatic withdrawal for Netflix. Well, guess what? The last three months the bank has changed the withdrawal date- a range of three days-all weekdays-to cause insufficient funds to occur. Talk about illegal manipulation of the dates! So, I am cancelling all automatic withdrawals, and moving to another bank as I am sick and tired of this bull! These crooked banksters are raking in billions of fees a year and getting bonuses for the crooked methods! Lets sue these bastards in small claims court and send a message! Costs 35 bucks to do it and just present the facts such as bank records and get a judgement from the court for your money back! If anything it will cost the banks time which is money!

For the second time BoA has charged me an overdraft fee though my checking account never actually went below zero. Had to go in to complain each time. The first time I had to complain to them for over an hour before they actually gave me my money back and tried to lecture me. The second time, about a year ago, was much faster but no real explanation for why this is happening. Seems deceptive and unethical. Very unhappy and will be looking to switch to credit union. Happy to participate in class action lawsuit.

I had a no interest account at Amazon which I paid off before the 24 months was up. Hundreds of people were charged interest from day one...simply by delaying or not recording payments on time. I sent my payment in 2 weeks in advance & did not get screwed like the others. I WILL NEVER AGAIN CHARGE ANYTHING AT AMAZON OR OPEN AN ACCOUNT AT WALMART UNTIL THEY DUMP SYNCHRONY. You can't even find their street address if you wanted to. Somewhere in Florida..What a joke.

my issue is with chase. I've had 16 accounts, business and personal with them for 15 years. Not only do they reorder their checks to charge the maximum amount of overdraft fees but they recently decided that the credit card that I have used for 15 years strictly for overdraft protection is no longer an option; however, the only option they now provide is to open yet another account and keep a surplus of money in it to cover the overdrafts. Like I have an extra $1000 to sit in an account, not earning interest, just sitting there, it's crazy. Also, on, for example, payroll weekends, if I make a transfer on a sat or sun to cover any checks that may clear before Monday, they will not apply my transfer or deposit until they process all of the debit card transactions and checks first; thereby applying as many overdraft fees as possible.
Why is there no regulation? all of these people have problems with so many banks yet no one does anything, I don't understand it, it's nuts. I'm happy to be a part of a class action or lawsuit; however, these banks are making so much money off of their customers that they don't care if they have to pay $400 million, it doesn't affect them so they keep doing it. what ever happened to customer service in this country?

My bank has a practice of putting overdraft fees on items that have not hard posted yet. They charged me 2 overdraft fees on 2 items that were in pending status. When those 2 items actually hard posted, it showed that my account was still on the positive side. Is there any kind of rule that they can only charge you an overdraft fee only after the item has hard posted? If not, there should be.

My account was hit with a PNC bank overdraft fee of 7.00 per day. In total I was hit with 77.00 in overdraft fees. I went into my local branch and spoke to a XXXXX at 10/25/2016. I advised her about my account. She decides to call a special department pertaining to the issue. She picked up her phone and it rang 3 pods over in the same bank. XXXXXX told me they and the other department could not help me. I called customer service on 10/26/2016 at 4:19pm and spoke with T Hen, operator, PLxxxx. I told her my problem and she adjusted all my 7.00 late fees off my account. I woke up around 7.15 am the next day another charge for 7.00 was assessed against my account. I called customer service and spoke to JJ, he wasn't able to override the charge nor wasn’t he willing to get off his ass and seek a manger to override it. I deposited a check for 200.00 around 117pm in the afternoon. So I called my local branch to see if they can override the 7.00 fee. They gave me the run around. I contacted KDKA pertaining with my issues earlier today with my account and obvious retaliation from prior incident of a teller giving me dirty money which should have been sent back to the Federal Reserve to be destroyed. My call to the bank in Murrysville and then called me KDKA both calls were lost. I am sitting here at 245pm and no one from the bank has called me back. I am on disability.

Wells Fargo (formerly Wachovia) has been doing this grift for a while. I brought it to the FORMER CEO's attention and he agreed with me. Then mysteriously he was terminated from the bank.

The trick is to run two sets of books (so to speak). Your transactions post to your account on THEIR database instantly! However, the customer viewed database is DELAYED! This sometimes causes low-fund accounts to go into NSF condition. But for some reason your view of the database (online banking) shows the INCORRECT data. I brought this to their cust serv dept and always was told this was SOP and they did nothing wrong. Then slowly the overdrafts line up one by one and you get charged $30 O.D. fee for EVERY item EACH!!! I have seen over $250 once in O.D. fees.

They agree to refund SOME of them but not all. Why agree to do that if you are not doing something wrong at the bank.

You tell them to just REJECT any debit card transactions that are unfunded. They say they do but it seems that is false as they allow the NSF transaction KNOWING the deposit has not cleared yet. You think the funds are there when they are not. They say you should have keep a ongoing check register on a debit card. Who does that?

A bit reassured to see I'm not the only one being shafted. But my story is old... Was living rough just moved to the area banking with Wachovia. Living out of hotels and my car while working full time going to school full time about 8 years ago. At the time I thought that my Direct Deposit was just slow, but reading through comments I think I'm sold on the debit/credit manipulation theory y'all got goin' on here. Anyway I left to head back home expecting my check to be in the bank. And from what I remember it was pending, but it never actually cleared. Well Wachovia hit me with something like 14, or 15 over draft fees @ $35 a pop. Bankrupted my account taking that whole check and it would have taken another two more to get back in the green if I hadn't cancelled my direct deposit. I Was only barely making above minimum wage at the time and as previously mentioned... wasn't in a place where I could lose two weeks worth of pay. At any rate I was able to get by and move on and told that bank to f--- off, but here I am nearly a decade later and I'm being summoned to court to answer for a substantially larger amount and I'm going to fight them. I'm going to fight them tooth and nail because THEY STOLE FROM ME. The money was there, it had been a steady job for nearly a year at that point. Check deposited regularly as it always was and just because it was pending and hadn't cleared they want to rape my accounts? I never spent above what I had in that instance, if you had added up all I spent, it would have been covered by the check had they debited after the credit, instead of the other way around but as has been noted here... that's not going to make them as much money as raking us over the coals.

So fight them. To all of you out there asking for help, looking for advice.... I saw someone else say it in the comments. Take these robbers to court. Make them answer for stealing your money, taking your livelihood. I'm seeking legal counsel and I will do everything to make sure those cretinous bloodsuckers get nothing more from me than they already have!

This is as bad as HIGHWAY ROBBERY! Columbia Bank, who bought out Panhandle State Bank, in Rathdrum Idaho., did the same type of thing to me with in 6 months of taking over. I had my account with Panhandle for 11 years, & never had a NSF charge, & was over draw many times, but never over 25.00, so they allowed me a decent amount for adding error etc. This is a small town bank, & when it was Panhandle, was a caring & right on Bank wish they would come back. As for Columbia, they must have a bank manager from California, or New York, because I was fired from my job because of having Stargart's disease, (I am going blind), I worked for 10 years @ Twin Lakes Golf Course, which is illegal to fire a person because of a Disability, ( I have 20/40 vision but loosing it steadily) I was 3 rd top key employee who just did flower beds & Certified Pool Manager. I had no income, had a small greenhouse so A Grower I new gave me credit so I sold some baskets & containers till Social Security approved me which was 9 months later. The small community & Landlord & even My credit card company's were sympathetic, & worked with me & waited for their money. Not COLUMBIA BANK!. What I sold I put in their bank to cover the 2 checks I wrote to my grower & what was left over was for me to pay rent & utilities & little food & gas. I would then call her after I sold enough to honor my promise to pay her first, & tell her go ahead & deposit the check. I made the deposit on Friday at closing time 5:30 of 520.00, which transactions after 4:00 aren't recorded till the next day or Monday if it's the weekend. She deposited my 500.00 check on Sat. at her bank, the next day. Now Monday I was over drawn for -612.00 . I also got gas of 10.00. How could this be. Well this is what they did. They ran her check, Sat. returned it, then the 32.00 NSF charge, Monday they ran the 10.00 for gas, & another 32.00 NSF charge & also ran her 500.00 check again for another 32.00 NSF chg & paid the check. Then also a 5.00 chg for my account being negative, not one day but for 2 days. Then they credited my deposit. 116.00 in fees left me 96.00 over drawn. The bank manager I talked to new & was aware of my crisis when I tried to close my account from the beginning, but assured me they would work with me too. It continue to escalate, after this, just trying to pay back the charges adding the transaction for water lights phone, I had to also pay. The manager would tell me how much i needed to deposit but wouldn't calculate the 5.00 negative balance charge, for that day because it hadn't posted to the account she was looking at on her pc monitor. Now all caught up. My sister has a business & She helped me by holding 2 checks for me till Monday. She was going to town to get supplies & do errands, also deposit in her business account which included my 2 checks, & was in Spokane Wa, 45 miles away, I asked her to deposit for me on the way, so I wouldn't have to close up & run to Rathdrum, which is 7 minutes away. The 2 checks I wrote to her bounced. My deposit slip which she gave me back that day, showed she deposited @ 9:32 Monday morning, She showed me her deposit slip, & it said 2:30pm later that day was the time she got to her bank "in Spokane 1 hour away" . My bank said that those checks came in before my deposit., well my sister was with me for that reason, & to The managers surprise, when she said, "YOU ARE A BALD FACE LIAR!" we showed her the deposit slips, she said those charges will be credited., I said along with you closing my account, & for those other charges last week, happen to add up to the checks that are do to hit this bank, but God I have no Idea when , the way you record transactions, but I say in 2 days. So that makes us even. At least it balanced out , but would not have if it wasn't for me & my sister catching them in the act. Some SMALL HOME TOWN BANK. I switched to Inland Northwest Bank in Spirit Lake Idaho, another small town 11miles away, ( I live in a really rural area) & now get a whopping 800.00 a month Social Security Disability direct deposit. For the last year my check is in my account on the 17th of every month. Except for July this month., it was the 20th. Social Security told me that it would be there around my Birthday the 11th, then it was the 16th, I have requested from the time I applied for Benefits tor all mail to be in extra large print for I can't see good enough to read it, my mother who lived with me at that time died suddenly @ 90 of Pancreas Cancer, whom did my reading & bill paying for me. God Bless her I miss her so. They never sent me a notice of change that my check wouldn't be deposited till the 20th, & my last 2 checks, BOUNCED, now I am 64.00 negative & will be charged 5.00 a day for the next 19 days till I get my check on the 20th. how do I stop that? Besides my creditors don't give a dam when they Social Security deposits my check they want their money on the due date. Like my Landlord , rent is due on the 1st & 35.00 late charge after the 5th. It is impossible for me to come up with a extra full months rent to keep me currant & stop being charged the late charge. Why can't I have my check direct deposited on the 1st. I am going to end up homeless all because of BANKS & SOCIAL SECURITY Their all crooks. Like Trump said Our BANKS & GOVERNMENT are corrupted, & the Law suits against them is the way, except I dont even have the 25.00 to do a civil suit, My bills come to 1000.00 a month & that just rent, utilities, gas, & insurance. I don't have TV, My only connection to the outside is my PC set up for the blind as is my phone (somewhat), my internet cost 55.00 per month & I am about ready to loose it. I have no way to fight back. This is what they want to do to us, is break you so you can be nothing but a slave to them &/or working for slave wages. In my case to them I am now just a useless undesirable, for I no longer pay income tax to them or put lots of money back into the system. As for all you others getting taken by the banks or Govt. agencies set them up, do as me & my sister did, & then take them to court it's a sure win...

My husband went into business with his best friend of 45yrs. They opened a business account together at Wells Fargo. My husband was primary funder and part owner but his friend had the tax ID they had planned to change it to the new tax Id under my husband once the paperwork was done and all proper licensing had been obtained. His friend could only physically withdraw from bank and had to have husbands authorization on $300 or more transactions. One long and painful story made grotesquely short his friend signed in online to the account as my husband using social and this was when Wells Fargo used the social for sign in on online banking couple years back but has since changed. Anyways he saw all the personal accounts listed under my husbands social and how much money, cards etc was available. Over the course of 3mths he manages to link all personal accounts to the business account, create new personal accounts, transfer thousands upon thousands of dollars daily through these accounts and into his account then closing the accounts, attaching a 10,000 secured credit card we hadn't even received yet in the mail to the business account and drained it by cash advancing into business account then into other new accounts and even assuming our 28yrs preferred customer status at wells account as primary and taking my husband off all his own accounts and overdrafting excessively 12+ accounts and doing all this acting as my husband online. Nobody at wells questioned the amount of accounts being opened and nobody filed a SAR report and nobody contacted us. When we could not use our cards and we were told his friend removed us from our own accounts they immediately said "wow this is crazy wild. Sorry this happened to you. Never put your friends or family on your account. Btw fraud department can't file because it was you who did all this and we are sending you to collections for not paying the $10,000 secured card you drained out we want your 10,000 secured money plus fees back, $5,000 in excessive overdraft fees and you will never have a bank account again cuz this was clearly you who did all this, it was your social at login every time and your signature on all the accounts he opened for you and all your approvals on $176,000 he drained from your personal accounts by linking to your business account and then you who opened those 12 accounts that no longer exist because you closed them and it's you who took yourself off the 28 yr preferred customer account that you were the primary for but now he is cause you removed yourself" is there not an ounce of moral fiber left in humanity?

I can't tell you all how many times this has happened to my room mate and I. We are barely making ends meet and we have been banking with Chase for years, only to find out that they've been robbing us by reordering our transactions so they can overdraft us $100s of dollars without us realizing.. meanwhile we're paying for gas, buying food, and getting $35 per transaction.. please tell me there's a way to get this money back..

I bank with acu they have charged me a 30.00 overdraft fee on 99cent twice, 2.08 and 1.35 twice. My information was recently stolen and someone place a 2300 dollar check into my acount. I alerted the bank and i still was responsible for almost for dollars more

Oh my gosh, Cape Cod! You are absolutely right! I can't believe I didn't see that before. If they are paying all of them anyway...... I had this issue once. Generally, we do not overdraw our account but during some lean times about 10 years ago we did due to a subtraction error. At any rate, they paid one large payment 1st, and then charged us overdraft fees on 3 other charges ranging from $1.XX to less than $15. I wrote a letter to the FDIC and we ended up getting our fees credited back, but it was still a major hassle. I was focused on "Who are they to decide what is most important to pay?" and never even thought about the fact that they are paying them all anyway so it's just a bunch of bs.

I have discovered by chance that banks are manipulating information to cause fees. Two times now I have noticed this. Generally when I make a purchase that purchase shows almost instantly on credit sometimes an authorization check usually $1.00 but varies. I have noticed that when this account gets low strange things begin to happen. first is debit card goes into credit card mode and quits showing up to date balance. purchases may take days to appear, although when they charge the fees they show a running time to the minute they say it was posted. two times this has happened. Kroger go in with maybe $20.00 in account buy something for $6.00 doesnt show for 3 days, sometimes card everywhere never acts as debit, but is forced to credit. I then deposit money, then whalla, instant running balance with pending charges. I can see where people who are always with a low balance gets fooled into fees. THIS NEEDS INVESTIGATION!!

I am not sure that the bank's reasoning on paying '"high to low" amounts holds water. The banks are saying that High-To-Low processing ensures that big important payments such as rent, mortgages, student loans are paid first. This makes no sense because the problem is all these payments are being made at the same time therefore causing the overdraft problem for customers. There is no benefit for the customer to rearrange payments. None what-so-ever. All the payments are being made. The only benefit is to the bank. Am I the only one seeing this?

I am a TD Bank customer. I have requested that the bank not provide me with an overdraft service and this does not stop them from allowing my account to continually overdraw. I have unknowingly had a negative balance and was given money at an atm machine at my bank. Then charged an overdraft fee. I have checked my balance before making transactions thinking that I am fine only to find the next day that a check cleared that night making every purchase made prior to the check clearing overdrawn. This they say is legal. Really frustrating. The bank says I should know what is in my account. This was easy back when the only transactions that came out were checks. No with automatic payments, checks, purchases, and bank fees it is nearly impossible for the average Joe who lives week to week. I have seen thousands from my account and it is heartbreaking. The people who can least afford it are most affected. The people who make the banking rules should really read these comments!!

Wells Fargo debited my account for a check I'd written, which was presented and then debited ONE DAY PRIOR TO THE DATE ON MY CHECK. Had the check (debit) been posted on the correct day, as check was dated, an automatic direct deposit on that day would have easily covered the check/debit amount.
My understanding has always been that CREDITS -- in this case, a Soc.Sec. direct deposit, immediately available -- are always posted before debits occurring on the same day.

PNC has repeatedly charged me overdraft fees when the posted balance in my checking account was positive. I just checked my account online and find that this week there were 3 consecutive overdraft fees and only the third put my account's posted balance into a negative balance. I keep trying to get them to admit that either these fees are in error or their posted balance is in error. Eventually they credit the overdraft fees back to my account, but this is so annoying.

An employer who gave me a check, had me cash it and transfer some funds to a friend. As it turned out,the check was fake and it got returned. it was a scam but, from what I understand, it took less than a day for the check to clear as I was surprised that they let me transfer the funds immediately(it usually takes at least 4 days to clear the check) Now, my account went into overdraft and they are telling me they can't do nothing. They were telling me they made the money 'available' since I have been a customer for over a year. Are they supposed to let that happen? What is your advice? How much would it cost me to file a lawsuit and get a lawyer?

PNC in Bank Sarasota , Florida ripped me off of $133 fees.
I deposited $12,853 from an attorney title company on December first.2015
PNC Bank paid four checks..of $2,397 total that day Decemeber 1, 2015..

Then On Dec 2,2015 Charge me over draft fee of $133..the following day saying my account did not have any funds in it...Yet they paid $2,397 in checks...Why ?..would they do that

My account had money in it..

Im with Regions Bank p8for 10 yrs.and have been just robbed for 72.00 dollars for .65 cents ... Ask me how or why... Well cause i have quote on quote i am not able to have deleverence of payment to another institution unless full payment amount is i. The account ..well thats nottruemy mortgage payment was due i put the full amount except for .65 cents... The bank allowed the mortgage company totake full payment retracted the payment n then.charged me 36.00 dollars. N told me its not an overdrft fee its an retraction fee ...then the mortgage company tried again ...and again i was taken for another rtraction fee. ... So i told the bank what they were doing and they told me thats the fee n ibcant get back my 72.00 dollars cause thats there fee aft re telling the bank hey this is my home payment ur me$ing with.... 72.00 for .65 cents ridiculous any one know of who i can get on board with this isnt the only time this has happened ....

Take them to court. In mass. Every single person can take their bank into small claims court for $25 and have them answer. They can NOT bring an attorney, and neither can you. Bring them in to court. You need to do this or simply accept what banks are doing to you. These comments do not get read by the banks.

I will be filing a small claims against KeyBank here in WA on January 4, 2016. I will show manipulation in order to increase profits.

Take your bank into court. If one person does this, nothing happens, but imagine now, across the country 10,000 and more do this, and it is a movement.

The courts are there for the American people to be heard. Do it there. Don't talk. Do. I applaud your fortitude in advance.

This is such a disgrace that in this day and time banks(J.P MORGAN CHASE) can get away with this type of deceptive practice of rearranging and leaving things in the pending status so long that they can reverse the order in which they say they were received and/paid to charge you as many overdraft fees as possible. It is one thing to actually owe the bank for one overdraft which I'm sure the average person wouldn't have a problem paying, but for them to turn it into 5 overdraft fees is not in any way fair to the people that are the reason why you are in business. This should be considered some type of fraud the is punishable by law to the CEO of these institutions. There should be something that the government can to do to prevent this practice from occurring. When the banks needed a bail out it was on the backs of everyday Americans who came to there rescue and this is HOW THEY REPAY US BY CONTINUING TO FIND WAYS TO RIP US OFF. SHAME ON ALL THE BANKS, THE LOBBYIST AND POLITICIANS WHO ALLOW THIS TO CONTINUE.

a there is a catch to opt out overdraft fees . I am a fix income senior and currently can not use cell phone ( waiting for the money for pre pay for cell service) there are no pay phones to call a bank . so when I wait for social security check to be deposited in the bank , two days later after the check is supposed to be there , I try buying something . card declined . I can not call but was told there is ATM refund . okay I use a ATM to find out no social security money . WHERE IS IT . here I get a ATM fee overdraft fee and service fee , I am in the negative fee . This is the $20 for ATM $20.50 bank communication access fee . where is the money probe fee of $25 and $34 in the negative fee . I was also slammed this for trying a withdraw of $20 a different time . the ATM clearly told me card declined in sufficient funds . the opt out was not used . what is supposed to be only $2 ATM fee , was a $156 nightmare for finding out money not there or was it intentional fraud .

Wells Fargo is putting credits through before debits - causing over draft fees along with charging a fee for automatically transferring money from one account to another that are linked for over draft protection. I am not really seeing any concrete answers if this is legal or not how do I find out if it they can or not. If not how do I go about fighting this?

I deposited $500.00 dollars at a Tri Counties Bank on Sat. Using one of their ATM's. As of today Monday the 9th. they say I'm overdrawn because I used the ATM and the funds won't be there until Tues. Morning...Mad ? You bet! I'm closing this acc. and going back to Wells Fargo.

I have been faithfully banking with Chase for over 3 years now. My first year of banking with them I was hit with numerous over draft fees at once not including what I spent. The mobile app that they had told me that I had a total of $430 in my account. While doing some Christmas shopping I decided to check my account just to be sure I didn't go over my remaining balance. I saw that I had $200+ in my account so I continued to shop. The next day I checked my account and I was $-300+ in my account. Why you may ask? Apparently there was a "glitch" in the system that showed me the wrong balance and for every transaction I was hit with a $34 over draft fee. At the time I had just graduated from high school and was working at a fast food restaurant. Being that I didn't have the $300+ to put into my account I had to wait until I got my NEXT paycheck. They took "their" money out of my pay checks for TWO BACK TO BACK WEEKS to pay back what I "owed" them

Beware of First Hawaiian Bank - they have made thousands of dollars on overdraft fees. Over the past few years I have seen through my online banking them manipulating the credits and debit causing overdraft fees upon overdraft fees stealing almost hundreds of dollars a day!!

First, open a new account, then close your current one.

Then, stop paying by way of checks, & stop automatic bill paying by the bank. Then, each month after your funds come in, draw money out of your new account to pay your monthly bills. By money orders for them at grocery stores, where they are much cheaper than at banks.

Cancel all automatic payments. Mail money orders to everyone you owe, instead of checks or automatic payments. You should have no more problems with overdrafts if you do this. If every-one paid by money order like this, that would put a screeching halt to this little scheme of theirs.

I realize the money-order process involves more work for you--bookkeeping, etc., but it will save you bundles of $$$.

I am looking at ways under the law to ding these guys big time, without having to go to court. You can't win in court, because it is rigged. The "judges" etc. all work in collusion with the bankers. You have to learn to do administrative processes, using affidavits. You can shut the bastards down by learning how to do administrative processes because this puts you into common law where you have rights--and how!

We don't have to take anymore crap from the system when we learn how to wield the sword. I will post more after I consult with some law gurus I know. There is a way to cut these criminals into little pieces. I believe there are ways to foreclose on these banks who do this, too.

i have been with my bank Chase for several years, and have been very happy with their service until recently. I had a $4.88 overdraft. Now the way my bank works, as long as you don't go over $5, you do not get hit with the $34 overdraft fee, however; if you have a negative balance, for more than five business days, you get hit with a $15 fee. A feature that they have is mobile banking. A friend gave me a $20 check to deposit into my account to prevent this $15 fee. Low and behold, when I tried to deposit the check, I got a message saying my account was ineligible for a mobile deposit. I was told that because I had a negative balance, I could not deposit the funds to cover that negative balance.
After that was settled and my account was back on the positive side, I did another transaction where I was a negative $0.17. I was going to have over $1000 deposited in my account in two days. The day before the transaction was to come through, I made two more purchases which would have cleared my account this morning, after the $1000 deposit. So to summarize, Sat, I had a -$0.17...then Monday I had a total of -13.33 all transactions were still pending at 2am, so these transactions had not yet cleared my account. This morning, I log into my account, and show I have two overdraft fees of $34...The bank took them off as a courtesy, but I don't think they should have been there in the first place...they told me that the transactions cleared at 11pm est..they did not, I did not go to bed till after 2am, and they had not yet cleared my account...

BEWARE of, Bank of America, They manipulate your account like crazy.

I have not been overdraft in over a year despite the efforts of Bank of America. Here are the weird things I have seen them do to manipulate my account and try to overdraft me in the last 6 months alone.

I should also say that this effort seems to be highly focused on accounts with Direct Deposit which routinely spend down the balance to less than $20 prior to the next Direct Deposited paycheck.

#1: Repeatedly altering the transaction dates for purchases. In one case I still had the store receipt from the far side of town which showed the date of the transaction, yet my account was showing it as processed the prior day which put me less than 1 dollar away from an overdraft.

#2: Transactions which were showing as "processing" would suddenly disappear and the funds would show as available and not be on hold anymore. Then when I spent money the "MISSING" transaction would pop back onto my account and the funds would be held again. (they almost got me a couple times with this one!) (It only happens the day prior to my direct deposit and when my balance is below $20)

#3: Misrepresenting the Available Balance, (I have seen this one twice) I will be monitoring my account closely and know the balance is lets say, $9 the balance will be the same for several days with no transactions having happened because I know I only have $9, then one day prior to my direct deposit, my account will be altered to reflect an available balance that is around $15 higher. The transactions on the history will not explain the balance at all. I'm 100% sure that if I were to spend into that ghost balance that it would revert to normal and put me into over draft.

Its completely shady and should be investigated. But why would Bank of America ever stop? They rack up $35,000,000 to $100,000,000 every year on shady overdraft fees. Their CEO has stated publicly that "Our customers understand that we have the right to make a profit" Why would they want to stop? They only have to pay back 10% every few years when they get sued by the victims.

This is all truthful info that I have witnessed repeatedly on my account. There is ABSOLUTELY no reason for my available balance to inflate by $15 right before my direct deposit. when there has been no activity on my account for a week, to see the balance increase, and then go back to normal when I get my deposit. Thats like putting food in front of a starving dog. Are they hoping that someone is out of groceries and assumes they have enough money for a gallon of milk and some food? Is it trying to tag overdraft fees on the poorest people who are least likely to raise a fuss or even realize they were just extorted for a $35 fee that was 100% generated by manipulating their account? I'm not an expert and these are just serious question to be investigated further. but everything I state as having witnessed on my account is 100% true. I'm going to starting taking screen shots and photos on my phone when this manipulation happens. Or perhaps just go to a credit union that isn't trying to rob me.

My husband and I are seeking legal counsel in the matter of illegal practices at Trust-mark National Bank. In the past 2 months our account has been hit with a whooping $2000 in NSF fee's and we opted out of the overdraft courtesy. They will not refund the fee's nor will they explain how our account is being charged these outlandish amount of unexplained bank fee's.

We spent thirty four years doing business with Bank of the West. We are loyal, honest people. It used to be a great bank. But the past several years there have been consistent problems with FiServ who Bank of the West contracts with for their Bill Pay and credit lending.

Instead of sending checks to our creditors, on several occasions they sent checks to us, with the creditors name upon them. When we called with complaints, they told us to forward their checks on despite the fact they are paid by the Bank of the West to perform the Billpay service. They were terribly rude and we had to pay late fees due to the delays in the mail. Bill Pay never resolved this issue with the fees. It cost us hundreds of dollars in late fees.

Due to the continuing problems with Bill Pay and the costs we had to pay, we finally closed our account with Bank of the West. The account was closed on April 29, 2015. All Bill Pay items for May were cancelled so there would be no issue with them. We paid our creditors ourselves for the May payments, through our new bank.

On June lst, despite having closed the account more than one month earlier and having a zero balance, Bill Pay reconstructed all our accounts and paid them. Realizing their error the next day, on the 2nd, they pulled back the funding resulting in hundreds of dollars in “returned check fees” from the creditor to us.

Only one account, Home Depot, cashed their FiServ payment of $150. All the rest they notified us about returned the funds to them. However, there were accounts which they did not notify us about which also charged us returned check fees. They suspended our account, despite the fact we had no account with them. We had an account with Bank of the West who contracts with them. And that account was closed five weeks prior to them paying creditors.

Apparently, to pay our creditors they must have had our information on a separate database, or they were allowed access to our personal accounts by Bank of the West. They paid last year's charges, not this year's.

On the 6th of June, after they claimed the the account was suspended on June 2nd, four days earlier (of which our account had been closed five weeks earlier) they again paid a creditor, our home mortgage company despite the account being "suspended" four days earlier and the account being closed with a zero balance at the end of April. This was for thousands of dollars. We were extremely concerned a fraud was occurring, especially since FiServ is paid per transaction with some creditors.

We have been assessed check return fees from many of the people Bank of the West's contractor paid. Why they paid by check, we do not know. All had online payment capabilities.

FiServ is now engaged in a harassment campaign of, calling daily and threatening us by telephone. There are several calls a day coming into one of our homes and they are now leaving threatening voice mails upon our cellular phones.

We insist on resolving this with Bank of the West, with whom we have a contract, not FiServ. Their contractors should not be harassing us. Today, they agreed to look into the matter. It is complicated as their contractor has racked up more than $4000 in fees and expenses as a result of what occurred.

We are also awaiting an apology, which has not come, as of yet. The first few steps we went through with Bank of the West was them stating we owed a debt. Now, they owe one to us which is almost double, as a result of FiServ.

I have been with Iberia Bank for 7 years. Im not understanding how I can be charged an overdraft fee when I OPTd out in the beginning. I have an account with Paypal threw Iberiabank. I currently have pending disputes with Paypal that has to be refunded back to my Iberia account but the manager who Iv been dealing with has been the most unprofessional lady Iv ever dealt with. I was charged 50 $35 overdraft charges when I only had 31 transactions, but the transactions werent even paid for so Paypal automaticly kept trying to take out money from my Iberia account. So I ended up getting all of these overdraft fees over and over and Paypal never got paid. The lady has had something against me for some reason. The manager closed my account with no warning and 5 open disputes still pending and owing me $1191. She accually put in money just to be able to close my account. She said the disputes were closed when they are still open even now. If they were closed money would have went back into my paypal and then back into my bank. She has said very rude things to me. Called both my fiance and I liars cause we said the ATM didnt work and said out of order. She rudely says theres nothing wrong with the ATM or I would No about it. The next time it happened we took a picture of the machine and address and shown her and she rolled her eyes never apologizing and started picking on my account ever since. In 7 this bank has stolen over $12000 in overdraft fees that I never agreed to EVER

Banks is West Virginia are trying to roll back a Consumer Protection Law in the state. This would allow them not be held liable for illegally charging you fees. Call your state representatives. Check your checking accounts, does your bank post your deposits as the last transaction of the day. They do this to overdraw your account. Statement at end of the month will not show, your deposit posted as last transaction of the day. Watch and print statements out from internet banking. Another way they charge fees, is through your escrow accounts. They raise the amount due on your insurance policies, then charge you a fee. They put your payments in unapplied funds, even if you are not late on payments and charge you a fee. If you suffer a loss as a tornado, flood, or damage to your home, many banks and insurance companies are conspiring against homeowners. Many banks have policies, if you have fees, late on payments they will deduct from your loss proceeds to repair your home. Homeowners pay the insurance companies for said policy. This is a breach of contract, when they allow banks to control loss checks. Banks and Insurance companies are working together: loss checks come in policy holders name as well as banks, they try to force you to use contractors even if you are educated in repairing your home, make you get building permits even if you live outside city limits. If this is occurring, Please contact me. I am now in the process of holding a local bank accountable for their illegal activity.

Over and over and over again, they have charged me overdraft fees for transactions that I actually made while the bank account was above zero. Their math consistently stretches the amount of time it takes various processes to run, in order to maximize the number of $35 fees they can possibly justify. I have asked them over and over again to simply tell merchants when the account is zero - it's a debit card!! However, TD Bank will approve transactions, then bill me the overdraft fees days later "when the transactions are run." They stole almost $5,000 from me in 2014. Many of these cases were runs of half a dozen transactions where my account would never have been below zero in the first place, if they hadn't started their run. I am so fed up with being abused by TD Bank and having my hard-earned money stolen by my own bank.

This bank hooks purchases and changes the posting order. In addition they will charge overdrafts for purchases that have not cleared, which causes overstay of cleared funds.

Bank of America placed overdraft protection on my account without authorization. Since then the bank has charged me about 30 overdraft fees. I asked them to take the protection off and they have told me they can take it off, but either way, I will be charged a fee. If they decline a transaction, they charge a $35 fee as well. This bank has literally charged me at east $1,000 in fees the past year. It’s sad that a billion-dollar company takes from people that can barely make it.

I checked my account one day before payday and noticed I had a pending transaction which would have thrown my checking account into a -$2.00. I immediately went to bank to deposit 5 bucks to "cover" the shortage. This morning, I check my balance and see the NSF charge. I don't understand how they get to charge the fee when the transaction has not been "settled" with the merchant. This is BBVA Compass, I have called about this previously and was given the ol' " we will return the fee as a courtesy" line. I don't consider it a courtesy, but a glitch in their system or another way to take your money. Don;t get me wrong, if it was a transaction that was posted , I would not be arguing the fee

Compass has a new way of generating NSF fees. When using their online bill pay, they will randomly select transactions to pay using a draft check rather than it being paid electronic. The draft check amount is not deducted from the account until it's cashed. They've done this to me several times now. They cannot explain why the same payee will be electronic one month and draft check the next. It's completely random.

Account holders BEWARE! Neither the transaction activity page nor the statement balance page reflect the true balance of what's in the account. They are re-ordering the transactions (because the customer has no way of knowing in the order they came in - only the mighty bank knows), so this works to their advantage in jacking up the overdraft fees. SO we have to trust THEM when they say what transaction came in first!? hmm....

They should be investigated again!

After years of paying overdraft fees I have spent hundreds perhaps thousands in over draft fees. The debit card is convenient to use and people in the check out lane look at you like you are crazy if you right a check instead of using the card.

When using the card instead of cash, there are a lot of smaller charges such as coffee or lunch. If for whatever the reason your account hits negative, any small purchase, even $1 will cause the same check charge that a $500 purchase would.

I can understand the bank takes some risk and they deserve some recompense but 2500% interest is more than usury. They will gladly continue to add up the charges with out any limit. I suspect the banking industry makes more money from overdraft fees on small accounts than they do on the interest from larger accounts.

I think there should be some regulation on overdraft fees and part of that regulation should include the fees being based on the amount of the overdraft. I think 10% up to $35 would be reasonable. So then if your account had five overdraft fees of $1 the total overdraft fee would be $.50 instead of the $175 currently charged.

If anyone knows of a law suit to reform the overdraft fee regulation in such a way I would gladly sign up.

We went into overdraft, and we had thought we didn't have this 'protection', the fee caused us to overdraw on bills that were scheduled to be paid, they weren't of course because we were now overdrawn because of the fee. Then we kept getting more overdrafts, and more. We stopped using the bank, and were still getting fees because of the bills we had scheduled to be paid from other vendors sites were already in motion. Soon we were getting extended overdraft fees. Ultimately, they charged us over $800 in fees. I have tried and tried to get some refunded, and they don't return my calls.

TD Bank has recently charged me $105 for being overdrawn by $14. Looking at my recent statement, they processed the highest amount first while three other purchases were processed causing the above fee. I called their 1-800 number and the representative was authorized to credit $35. I explained to them that my daughter had made an unauthorized purchase but that didn't matter. Research shows that the banks make billions of dollars in overdraft fees. To me this is a true fleecing of the middle class worker.

We just received our 2012 and 2013 bank statements to overview how much in overdrafts fees we were charged before we changed banks. Just in the year of 2012 we were charged $2,800 in overdraft fees out of our business checking account! Our business almost went under because of this. We have been with Chase Bank for a year and have had one overdraft fee. We believe we are entitled to compensation for this. I don't know how that is legal for them to do.

When I signed up for my checking account, I opted “no” for overdraft. Then all of the sudden they say I opted in online, and that is false. I now have $500.00 in overdraft fees. Bank is located in SC.

They consistently process my transactions out of order causing me unwarranted overdraft fees. This usually happens over the weekend and they post my debits the following Tuesday completely out of order.

Golden One Credit Union presents itself to be a small bank/ credit union but is actually excessive and inflexible with their overdraft policies. Im on disability and have been charged over $300 in the two month in fees. My overdrafts are due to some unauthorized payments that grew into a larger sum of money. Golden One reps aren't helpful at all. Golden One is more aggressive with fees than the larger banks. To any one considering going with Golden One Should consider sticking with the large banks. There's no benefit in dealing with small banks like Golden One.

I have had multiple concerns with this bank recently. Starting with a dispute where they gave me provisional credit then reversed it without notice more than once, which resulted in overdraft fees. Then I was able to get them to refund the fees only to reverse the credit a 3rd time resulting in more overdraft fees. They have re-ordered my debits largest to smallest to maximize their fees and even have charged fees on a positive balance. This is not the first time they have done the re-order or charged on a positive balance.

BB&T has a series of rules that allows it during nightly processing to make it more likely that a phantom overdraft will be created that they can use to collect overdraft fees. In my case the byzantine process included limiting a deposit for over $3,000 to be valued at $100 for the purposes of the processing cycle (the full amount was available after processing was complete), taking into account a scheduled electronic payment that was not due for another two days, ignoring a line of credit that was there for overdraft protection and process charges in an order that no customer can ever know or predict. The bottom line is you can start off the processing cycle with cash in the bank. pay multiple overdraft charges because of literally a phantom overdraft that never really exists other than as distorted calculation and end the processing with money in the bank and never have a statement showing that you were ever overdrawn!

Bank of America is routinely backdating transactions in order to generate overdraft fees. In the most recent example I successfully transferred 34 dollars to another BOA customer on-line. If I hadn't had sufficient funds, the system would not have allowed me to do the transfer. Then after midnight, the next day, BOA's systems processes a purchase for gasoline in the amount of ten dollars and backdates the purchase to the previous day, placing the gas purchase ahead of the on-line transfer which then "changes history" by making it appear as though at the time of my on-line customer to customer transfer, an overdraft occurred.

Again this is impossible because if this online transfer had in fact created an overdraft at the time it was done the bank would never have let me do it. It's only after the bank backdate’s the 10 dollar gas purchase and restates history, that the overdraft is able to occur. They are effectively rewriting history-injecting a transaction from one day into the previous day's transaction history and re-dating it to cause the overdraft in order to generate the fee.

What makes this particularly annoying and frustrating is the fact that I can use my Paypal card to make a purchase which then generates an ACH debit which is sent to Bank of America to pass along to my account. I wake up the next morning, confirm the debit has taken place which also happens to bring my BOA account negative. But here's the frustrating difference: in this alternative scenario I am aware of the negative balance-I cover the overdraft by making a cash deposit before 8 p.m. and Bank of America in this scenario CHARGES ME NO FEE.

Here's the difference in the two scenarios. In scenario number one, I am NOT made aware of the negative balance on the day that it occurs and am unable to resolve it because IT NEVER ACTUALLY EXISTS ON THAT DAY BECAUSE IT ONLY EXISTS AS A RESULT OF BEING BACKDATED AND SHOWING AS AN OVERDRAFT A F T E R T H E F A C T-AFTER HISTORY HAS BEEN REWRITTEN THE NEXT DAY.

Business account was charged over $1000 in overdraft fees when the account never appeared to be overdrawn. Not a single employee at two different branches could offer an explanation. They only offered a $70 courtesy refund and initiated a 'research request' into the transactions.

I took a loan from B o A in 2008 for $35,000. The credit line was for $37,000 but I only borrowed $35,000. They charged me $1,000 for the transfer of the loan and added other charges that made the credit line go over without telling me. For over five years, I have paid them $804.00 a month. I have paid them over $50,000. They claim I still owe $30,000.

I have received several overdraft fees as a result of putting a hold on transfers between accounts, even though the actual cash was transferred immediately. Furthermore, I have received fees from what I believe is re-ordering of transactions.

Suntrust recently processed my largest transactions first, in descending order. Putting me nearly $500 in negative because of overdraft fees, and causing me to lose my paycheck this lasty payday, and the next. Essentially, it's like I was out of work for a month.

Clearing most all of my transactions, ironically, when my balance is almost at $0 so that it overdrafts my account- the bank does this multiple times once I am overdrafted so that they continuously charge me a $35 overdraft charge multiple times. Excessively to almost $400 bi weekly.

I had no overdraft protection account, but the bank continuously chose to pay my overdrawn account so they could charge me $35 for ea. incident. They reordered the charges and charged me for dozens, upon dozens of incidents when i should have only incurred 1 fee. This went on for years. I complained many times.

What would have been one $35 overdraft fee ballooned to over $200 and caused a $500 direct deposit to bring my balance up to only $103. I would describe what the bank (Wachovia) did, as willfully participating in "usery".

I have had to take out pay day loans to have gas and grocery money. I am claiming bankruptcy. I have had to pay thousands in fees, I have even been charged overdraft fees for the overdraft fee transactions!! Other banks in WI do the same thing so I can't change banks. If fact Chase gave me 2 x $3000 charge cards to cover the overdrafts, which of course were over the limit and at 26 percent interest shortly after being activated.

United Bank in West Virginia reordered my debits to my account allowing the largest (which was the last debit) to be placed first causing numerous overdrafts instead of just one. They have done this to me several times and each time it has cost me several hundred dollars each time.

I would estimate the amount well over 2000 dollars, one of which the most recent, they charged me 140.00 on an account that had a transfer made to it prior to a payment. They bounced everything and held the credit until all others were no longer pending

Since end of 9/09 I have been hit with overdraft fees by TD Bank. These fees are hitting my account for items that have been authorized, but not posted. For instance, I had a $1.00 pending authorization on my account that had a .58 balance. TD charged me $35.00 for the transaction even though the merchant hadn't settled the credit card charge thereby causing a domino effect on my financial situation.

My bank paid one check for 1000.00 before they paid 10 debit card purchases that were authorized 4 days before the check hit. They then paid all of the debit card charges from 4-65.00 so they could charge me 35.00 on each one. Then after that on another account, even though I was about 8.00 negative they paid a 29.00 automatic charge so they could charge me 35.00. They do this quite often.
