Wyoming Worker's Safety and Compensation Division

A class action lawsuit has been filed against the Wyoming Worker's Safety and Compensation Division for allegedly violating constitutional rights by denying worker's compensation extended benefits if household income exceeds expenses. A 1993 Wyoming state law allows the state to consider all household income in determining eligibility for extended worker's compensation benefits. In 1998, Legislature passed a law clarifying its intent that spousal and other household income is not be considered in determining an injured worker's entitled to extended permanent total disability benefits.
