A lawsuit seeking class action status has been filed against Whirlpool Corporation asserting certain claims in connection with alleged defective refrigerators.

The suit alleges that the icemakers in the side-by-side refrigerators do not work and the temperature controls fluctuate, which leads to flooding and water and property damage to the home. The defect reduces the effectiveness and performance of the refrigerators and renders them unable to perform the ordinary purposes for which they are used. To date, however, Whirlpool allegedly has failed to institute a program to repair and,/or replace these refrigerators and has refused consumer requests to repair or replace the refrigerators and/or reimbuse consumers for damages when such refrigerators are outside the warranty period. Whirlpool is accused of knowing about the defect and failing to notify consumers of the risk of property damage.

The suit makes claims on behalf of all persons in the United States who purchased a side-by-side refrigerator manufactured by Whirlpool since 2000 and sold under the Whirlpool, Kitchen Aid and Roper brand names.
