Valero Energy and Bay Ltd.
A class action lawsuit has been filed in Jefferson County District Court naming Valero Energy and Bay Ltd. as defendants. The suit alleges that the oil giant classified workers’ wages as ‘per day pay’ in order to not pay its contractors the standard overtime rate. Under the Fair Labor Standards Act, hours worked in excess of 40 hours per week are subject to one and one-half times the worker's regular pay rate.
The suit further claims that Valero and Bay did “artificially and knowingly attempted to characterize a weekly payment as a 'per diem,' not subject to payment of the overtime rate.” This would constitute the defendant's willful violation of the FLSA, and provide for recovery of attorney's fees, and pre-judgment and post- judgment interest on all damages in addition to their unpaid overtime wages at one-and-one-half times their true regular rate.
