Patients Sue Urology Clinic Over use of Possible Exposure to HIV and Hepatitis

Disposable Medical Equipment Re-used

Five patients from Iowa who underwent cystoscopy procedures at the Siouxland Urology Center in Dakota Dunes, SD, have filed a medical malpractice class action against the facility alleging that they may be been exposed to blood-borne pathogens such as HIV and Hepatitis from contaminated equipment.

Reportedly, the South Dakota Department of Health sent a news release out last Wednesday indicating that items meant for one-time use such as saline solution bags and tubing were re-used on more than one patient prior to being thrown out. Consequently, people who underwent the procedure at the centre are at risk for infection and should be tested immediately.

More than 5,000 people underwent cystoscopies at the center and are potentially affected by this situation. The clinic opened its doors in 2002, and has allegedly been re-using disposable medical equipment from March 2002 up until January 2009. The center sent out letters to its patients about the situation, indicating that the risk for infection is low, and has begun free testing for HIV, and Hepatitis B and C.

The class action alleges negligence, medical malpractice, intentional and negligent infliction of emotional distress, battery, fraudulent misrepresentation and unjust enrichment.
