Truckee-Carson Irrigation District, CRCH Ltd., Fernley, NV and Lyon County, NV

A lawsuit has been filed and is seeking class action status against the canal operator, homebuilder, and local governments alleging negligence after an irrigation canal ruptured in northern Nevada and flooded hundreds of homes. The lawsuit was filed in Washoe County District Court in Reno and claims the Truckee-Carson Irrigation District failed to stem the flow of water during a powerful Jan. 5, 2007 storm, which contributed to the canal breach. The suit alleges Fernley and Lyon County did not have an adequate emergency response plan in place and CRCH Ltd. failed to notify new home buyers of the potential risk.

The lawsuit alleges inadequate maintenance of the canal resulted in the breach, and the failure to turn off the valve, for three hours after the canal was breached, greatly increased the quantity of water that was spread throughout the homes.
