A federal lawsuit has been filed and is seeking class action status against the city and the two police officers. The lawsuit was filed on behalf of everyone within Roanoke city limits and claims city police are not arresting felons whom they find with firearms. The lawsuit alleges the city deprived its people of the due process and equal protection rights held under the fifth and 14th amendments to the US Constitution. It also accuses Roanoke with nonfeasance or the failure to act.
