Red Eye's Dock Bar reaches $75,000 settlement in wrongful termination lawsuit.

Annapolis, MD: (May-28-08) Margaret Finley, a 56-year-old bartender, brought a lawsuit against Red Eye's Dock Bar, a Kent Island business, alleging that she was wrongfully terminated after her refusal to wear a tight tank top. Finley claimed that she refused to wear the ensemble as it revealed scars from a breast cancer surgery. Records stated that Finley worked at Red Eye's for 11 years, tending bar on weekends from May to September until she was diagnosed with breast cancer in 2004. Following that, she underwent chemotherapy, radiation and a lumpectomy before returning to work in May 2006.

As part of a settlement reached in the case, the bar's owner, Bob Wilson, though not admitting to the allegations or accepting any wrongdoing, agreed to resolve the lawsuit with a $75,000 payout. The suit, brought by the US Equal Employment and Opportunity Commission, on behalf of Finley, culminated in Wilson agreeing to send his managers and employees to special work force training. Norm Refford, a manager at Red Eye's stated that other female employees still must wear the skimpy tops.
