Nom Shim Foods

A class action lawsuit was filed against Nom Shim Foods on behalf of current and former workers of the company. Filed in the Superior Court of California in Los Angeles, the suit alleges Nom Shim Foods failed to properly pay employees and acted unlawfully in business practices toward its workers. Additionally, the Rancho Cucamonga based Nom Shim, a maker of packaged snack foods and instant noodle dishes, is alleged to have failed to pay adequate wages and overtime. The lawsuit could represent several hundred workers.

The complaint claims that workers at the Rancho Cucamonga warehouse were not paid for the time required to at the beginning and end of each shift to change into, and back out of, protective clothing and shoes they were required to wear and to pass through the mandatory sanitation equipment. One former worker speculates he was shorted an average of 20 minutes per day for each day he worked for the company. If allegations are found to be true, Nom Shim would be in violation of the California Industrial Welfare Commission Wage Orders, the California Labor Code and the California Business and Professions code.
