Lexus Inc. and Toyota Motor Sales Inc.



A lawsuit has been filed and is seeking class action status against the car makers for allegedly failing to correct problems with the front passenger air bag system in thousands of 2007 Lexus ES350 vehicles. The lawsuit was filed in Broward County Circuit Court and claims the sensor under the front passenger seat of all ES350s sometimes doesn't work and may fail to trigger the air bag in a collision.

The suit was filed on behalf of all ES350 owners and claims Lexus has refused to correct the problem. The lawsuit claims that by equipping their vehicles with the defective airbag occupant classification sensor systems, the defendants have breached their expressed and implied warranties in violation of Florida law. The suit seeks to make Lexus recall and repurchase ES350s at full cost, give full refunds for those people who have leased their vehicles, refit the cars with functioning airbag systems; and also asks for compensatory damages for all costs and loss of value.
