AMID/Metro Partnership LLC and New Orleans, LA

A lawsuit has been filed and is seeking class action status against the city and Old Gentilly Landfill operators for allegedly using private land to handle Hurricane Katrina debris. The suit alleges that the city and the landfill's operator, AMID/Metro Partnership LLC, illegally dumped 10 million cubic yards of waste on land that neither owns. Dozens of individuals and entities claim they never gave the city permission to dump on their land and never received any financial compensation for all the waste that is now piled there. Over the past two years, it is estimated that the landfill has generated and collected tens of millions of dollars.

The suit seeks to require the operators to provide landowners a share of the tipping fees taken in thus, and to prevent them from trespassing further on any one's property. The suit also requests that all owners of properties used as landfill be given insurance policies protecting them from future liability arising from the refuse on the site.
