Kohler Employee Wage & Hour Class Action Certified

New York, NY: A federal magistrate has certified a wage and hour class action lawsuit against Kohler Co, a manufacturer of kitchen and bath products, engines and power generation systems, cabinetry, tile and home interiors, and an operator of high-end hospitality properties and golf courses.

As many as 140 employees may be involved in the lawsuit, which is headed to court. The employees allege that they were not properly paid for all hours they worked. Specifically, the complaint alleges that Kohler permitted administrative employees to work “off-the-clock” to finish assigned work without being paid. The Kohler employees are alleged to have completed their assignments before or after their assigned shifts and/or during their unpaid lunch breaks.

The magistrate ruled that the employees “need only demonstrate that they worked uncompensated overtime on the employer’s premises to create a presumption that the employer knew or should have known about the additional work time,” according to a lawyer representing the employees.
