State of Florida



Class action status is being sought in a lawsuit filed against the State of Florida on behalf of 16,000 Florida nursing home residents. The suit alleges that the state is violating a federal law which requires the state to deduct the extra insurance premiums and other out-of-pocket medical expenses from a patient's income before calculating how much of the income should go to a nursing home. The suit is seeking to force the state to allow the nursing home residents to keep enough money to pay for supplemental insurance premiums and other necessary expenses.
