Insurance for Eating Disorder Treatment Basis for Lawsuits

Families Resorting to Lawsuits, Even When They Have Health Insurance

Families with children who have eating disorders are resorting to lawsuits to get their health insurers to cover the costs of the associated medical treatment. In many states the law does not require that health insurers cover these costs, but instead cover the costs of treating mental illnesses considered to be biologically based, which includes obsessive-compulsive disorder.

However, Anorexia, for example, is biological, according to many experts. Recently, a Hartford, CN., based insurance company settled a claim made by more than 100 families facing medical costs connected with eating disorder treatment. The settlement was for $250,000, for claims dating back to 2001. It is considered a landmark settlement.
