Dollar Tree Stores Hourly Employees Bring Class Action

Ft. Lauderdale, FL: - On September 1, 2010, two assistant store managers (hourly employees) filed a collective action under the Fair Labor Standards Act (FLSA) for failure to pay minimum wage and overtime compensation.

Dollar Tree operates thousands of stores in all 48 contiguous states, with its headquarters located in Chesapeake, Virginia. Their website boasts that they are the largest and most successful single price-point retailer in the country. Joann Badgett and Solomon Morgan, the plaintiffs who filed the lawsuit, worked in stores located in South Florida.

Plaintiffs seek to have their claims certified as a collective action under the Fair Labor Standards Act ("FLSA,") (a type of class action in which individuals employed in similar job positions are provided with an opportunity to pursue minimum wage and overtime pay claims by opting into a lawsuit filed by representative plaintiffs.)
