A lawsuit has been filed and is seeking class action status against the Canadian Government for allegedly clawing back disability income from those who suffered injuries while in the army. Under the military's insurance plan, which everyone in uniform must join, those who become physically disabled on the job are entitled to three-quarters of their former income for two years. However, the plan considers monthly Pension Act disability money as a relevant source of income and deducts such pensions from the amount that would otherwise be paid to former Canadian Forces members. Potential class members claim disability pension was not meant to act as income replacement but to compensate them for the pain and suffering they had endured as a result of becoming disabled while serving their country.
