Dell Call Center Employees
Call center employees have filed a wage and hour class action against Dell. The case is David Norman et.al v. Dell, Inc, et. al.. Case No. 6:07-CV-6026-TC filed in U.S. District Court in Eugene, Oregon. The class representatives are David Norman and Walter Romas, both of Roseburg, Oregon.
The lawsuit alleges that Dell consistently violates federal and state wage and hour laws by failing to accurately record all time worked and failing to pay earned wages and overtime.
Examples of the unlawful practices claimed include:
- requiring employees to work "off the clock" by not paying for work performed pre-shift, post-shift, and over unpaid meal breaks;
- utilizing an inherently inaccurate time-keeping system called "Kronos;" and
- improperly calculating overtime using a "half-time" overtime rate. The workers are seeking class action status. SSHW is also investigating Dell's compensation practices at other call centers located in Texas, Oklahoma, Idaho, Tennessee and other states.
