Two Cold Medicines Sued for Misleading Consumers

Two lawsuits seeking class action status have been filed against 2 cold medicines, CVS AirShield products and Ideavillage NutaMist Immune Boost, respectively, alleging that the medicines were marketed using unfair and/or deceptive practices designed to convince consumers that the products boost people's immune systems, thereby preventing illness.

The plaintiffs are asking that the suit against CVS be certified as a statutory fraud count and unjust enrichment claim, and are seeking no more than $75,000 in damages per class member.

The suit against Ideavillage is seeking an unjust enrichment claim, and the complaint states that the defendant has "no scientific or otherwise legitimate basis for making any of its health efficacy claims, and such claims are thus unfair, unjust and deceptive." The plaintiffs are seeking damages and costs.
