A class action lawsuit has been filed against the cell phone company regarding deceptive charges for roadside assistance. Cingular fraudulently imposed a $2.99 monthly charge for a purportedly optional roadside assistance service that customer never requested. The roadside program includes a towing service, battery service, flat tire assistance, fuel delivery service, lockout assistance and key replacement. The class action lawsuit was filed in Kanawha Circuit Court and claims customers were not given an option to include roadside assistance, but rather it was included as part of a bundled transaction.
