A lawsuit has been filed and is seeking class action status against the city and one of its police officers regarding its vehicle seizure ordinance. The suit was filed in US District Court and cites violations of the 4th and 14th amendments in accusing North Chicago Police Officer Donald Florance of making unreasonable search and seizures. The lawsuit was filed on behalf of all persons or entities who have and their vehicles towed, seized or taken in any manner by the City of North Chicago through its police officers in violation of their constitutional rights.

A city ordinance adopted in 2004 allows for the impoundment of any vehicle used to carry an illegal firearm or ammunition, controlled substance, open alcohol or in connection with prostitution and other crimes. An amendment to the ordinance, which also allows for towing for lack of license and insurance, was approved in 2006.
