Nursing Student Harassed

Tacoma, WA: (Mar-25-08) Alycia Carmichael-Milan, a former nursing student at Bates Technical College, brought a lawsuit against the school, alleging that she faced retaliation after she complained of physical mistreatment. The suit claimed that Carmichael-Milan was suspended from the school's nursing program for 12 weeks in March 2006, after she had complained that an instructor had physically mistreated her. She stated that when she appealed her suspension, she faced a unanimous vote against her by the school's disciplinary committee.

The committee had stated that Carmichael-Milan had been untruthful about the incident and was at fault for disobeying rules and behaving in a threatening and disrespectful manner. The ruling spurred Carmichael-Milan to file suit against the school. She claimed in her lawsuit, that she had the rights of free speech and to petition for redress of grievances that had been violated.

As part of a settlement reached in the case, sources on both sides revealed that the Bates Technical College agreed to pay the former student $105,000 to resolve allegations. Bates said that she agreed to settle the case rather than go to trial and take on the costs and risks of litigation. [THE NEWS TRIBUNE: FORMER BATES NURSING STUDENT AWARDED $105,000 IN SETTLEMENT]
