Apple Faces Class Action over Defective Glass in iPhone 4

Palo Alto, CA: Apple is facing a consumer fraud class action lawsuit over allegations that the glass used its iPhone 4 is defective. Dubbed 'glassgate', the suit claims that Apple is marketing the phone on the strength of the iPhone $ being "20 times stiffer and 30 times harder than plastic" and is "ultradurable" and crafted from the same type of "glass used in helicopters and high-speed trains."

Donald LeBuhn, of Los Angeles, filed the class action against Apple. He claims that the iPhone 4 is not as durable as Apple claims and that Apple continues to sell the product without warning customers of its defective glass housing.

LeBuhn had spent $252 in September for his new iPhone 4, but within three weeks, the glass broke after his daughter accidentally dropped it from about three feet off the ground while sending a text message. He alleges that a similar accident happened with his previous iPhone 3GS, but the glass on that phone did not break when that phone was dropped.
